MANILA, Philippines – Hinatulan ng Senate Impeachment Court sa pamamagitan ni presiding officer Francis Chiz Escudero nitong Martes na hindi maaaring pilitin si Vice President Sara Duterte na umamin na pagmamay-ari niya ang mga bank account na isinumite bilang ebidensya sa impeachment trial.
Inilabas ang hatol matapos bawiin ng House prosecution panel ang kanilang “Request for Admission” noong Lunes.
Sa halip, hiniling nila sa depensa na pumayag sa stipulation o kasunduan na tunay at galing sa bangko ang mga bank records.
“The impeachment court, therefore, rules that respondent cannot be required to serve a written response to the request for admission,” sabi ni Escudero.
Sakop ng hiling ng prosecution ang 104 na bagay — kabilang ang personal na detalye ni Duterte, dating pwesto sa gobyerno, business interest’s ng asawa, at iba’t ibang bank records.
Tinutulan ito ng depensa at humingi pa na burahin sa record ng korte ang request. Pero kahit binawi na ng prosecution, sinabi ng korte na kailangan pa rin nitong sagutin para maging gabay sa susunod na pagdinig.
“Respondent need not answer the request for admission and her failure to answer shall not be deemed an admission,” ani Escudero.
“However, her prayer to expunge the request is denied. The request, the objection, and this ruling shall remain in the record,” dagdag niya, pero binigyang-diin na wala itong magiging “evidentiary, factual, or prejudicial effect” laban kay VP Duterte.
Paliwanag ni Escudero, hindi maaaring mangibabaw ang Rule 26 ng Rules of Civil Procedure sa Section 17, Article III ng Konstitusyon na nagsasabing “no person shall be compelled to be a witness against himself.”
Nagsasabi ang Rule 26 na maaaring hingan ang kabilang partido ng written admission sa mga dokumento. Pero ayon kay Escudero, dahil kailangang isagot ito nang naka-oath, nalalagay sa panganib ang respondent sa perjury — isa ring uri ng pamimilit.
Binanggit din niya ang desisyon sa Duterte vs. House of Representatives at Gutierrez vs. House of Representatives na nagsasabing kahit hindi criminal ang impeachment, ito ay “analogous to a criminal trial” at sakop pa rin ng Bill of Rights.
“While the impeachment court welcomes the prosecution’s desire to narrow the issues for trial… any such measure to expedite the proceedings must always yield to the protection of the substantial rights of the respondent under the Constitution,” sabi ni Escudero.
Idinagdag ng presiding officer na hindi maaaring gawing kapalit ng ebidensya ang “discovery” o request for admission.
“The prosecution cannot shift its burden of proof to the respondent through the simple expedience of a request for admission,” aniya.
Ang prosecution ay kasalukuyang nagpe-presenta ng ebidensya para sa Article II ng impeachment complaint na nagsasabing nagkamal ng unexplained wealth si VP Duterte dahil sa hindi kumpleto at hindi tapat na deklarasyon sa SALN, at dahil hindi umano siya nag-divest sa business interests habang nakaupo bilang bise presidente.
