MANILA, Philippines – Ginawaran ni Pangulong Ferdinand Marcos Jr. ng executive clemency ang 22 persons deprived of liberty (PDL), sinabi ng Bureau of Corrections (BuCor) nitong Sabado, Marso 9.
Anang BuCor, binigyan ng ‘commutations of sentences’ ang 20 PDLs habang ang dalawa ay binigyan ng conditional pardon. Ito ay ang magkapatid na sina Alfredo at Leopold Bongcawel.
Sinabi ni BuCor Director General Gregorio Pio Catapang Jr. na ipoproseso nila ang pagpapalaya sa magkapatid na Bongcawel basta’t hindi na sila “again violate any of our penal laws.”
Ipinaliwanag ng kawanihan na ang executive clemency ay tumutukoy sa “commutation of sentence, conditional pardon and absolute pardon” batay sa rekomendasyon ng Board of Pardons and Paroles.
Ani Catapang, dalawang PDLs, na sina Roberto Gaut at Pablito Alvaran Jr., ay nakapagsilbi na ng kanilang maximum sentence bago sila pakawalan.
Ang iba pang mga PDL na ginawaran ng executive clemency ay sina Evelyn Palarca, Dioscoro Talapian, Venancio Abanes, Avelino Tadina, Fernando San Jose, Quirino de Torres, Bonifacio Besana, Bernabe Cabrales, Anselmo delas Alas, Arcadio Venzon, Danilo Cabase, Beverly Tibo-Tan, Aurora Ambrocio, Felipe Galarion, Armando Dante, Leopoldo Conlu, Alex Valencerina at Alfredo Toral.
Ayon sa BuCor, ipinag-utos ni Justice Secretary Jesus Crispin Remulla ang pagpapalaya sa walong PDL na nakapagsilbi na ng kanilang maximum sentence matapos bawasan ng credits na nakuha sa ilalim ng good conduct time allowance (GCTA) law.
Binabawasan ng GCTA ang sentensya sa mga PDL na nagpapakita ng maayos na kilos.
Inaprubahan ni Remulla ang pagpapalaya kina Zaldy Francisco, Benedicto Ramos, David Garcia, Bernardo de Guzman, Rodel Garcia, Armando Canillo, Edilberto Platon at Josefina Patanao.
Anang BuCor, batay sa kanilang rekord, ang walong PDL ay sinentensyahan ng one count ng reclusion perpetua o habambuhay na pagkakakulong, o maximum na 40 taon.
Sa ilalim ng Department Order No. 652 na pinirmahan noong Nobyembre 2022, “the release of all PDLs incarcerated in national penitentiaries with expired sentences shall be approved by the director general of BuCor or his duly authorized representative, in accordance with the mandate of the Bureau.”
Dagdag pa, “the release of PDLs sentenced to life imprisonment or reclusion perpetua or those classified as high-risk/highprofile shall be implemented only upon prior approval of the secretary of justice.” RNT/JGC
