MANILA, Philippines- Hiniling sa Supreme Court (SC) ng grupo umano ng registered voters sa Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) na huwag payagan ang appointive officials ng Bangsamoro Transition Authority (BTA) na manatili sa kanilang pwesto kahit nakapaghain na ang mga ito ng kanilang certificates of candidacy (COCs) para sa 2025 elections.
Sa petisyon ng nagpakilalang grupo ng registered voters sa BARMM, kinuwestyon ang legalidad ng probisyon sa Bangsamoro Electoral Code (BEC) at rules ng Commission on Elections (Comelec).
Kinuwestyon ang mga unang sentence ng Section 8, Article IV at Section 3, Article X ng BEC kung saan hindi maituturing na nagbitiw sa pwesto ang nominees ng political parties para sa party representative seats maging ang mga kasalukuyang appointed members ng BTA kahit nakapaghain na sila ng kanilang Certificate of Nomination and Acceptance of Nomination (CONAN).
Kinuwestyon din ang unang paragraph ng Section 21 at ikalawang paragraph ng Section 44(a) ng Comelec Resolution No. 11045, na nagpatupad sa probisyon ng BEC.
Kabilang sa petitioners sina Mustapha Kabalu, abogadong si Badrodin Mangindra, Saad Delna, Soekarno Mohammad at Punduma Sani l.
Nais ng mga petitioner na maglabas ang SC ng temporary restraining order (TRO).
Nakasaad sa petisyon na ang mga probisyon sa BEC at Comelec resolution ay unconstitutional dahil labag ito sa Section 2(4), Article IX-B ng Konstitusyon kung saan bawal ang civil service officers at employees na lumahok sa electioneering at partisan political campaign.
“The mere filing of the CoC and the Certificate of Acceptance of Nomination are also signs of partisan political activity. The constitution and national laws clearly provide that public appointive officials shall be deemed ipso facto resigned upon entering the political arena.”
Dahil sa naturang probisyon, nakakalamang ng hindi tama ang mga opisyal sa BARMM dahil ang mga kandidato sa labas ng BARMM ay awtomatikong wala na sa pwesto matapos makapaghain ng kanilang COC at CONAN.
“Thus, unless a temporary restraining order is issued by the SC, our country will have that ridiculous and anomalous situation wherein BARMM appointed officials who have filed their COC and CONAN in the 2025 elections will be seen continuously enjoying all the perks and privileges of his office while campaigning in the said election while public officials in areas outside of the BARMM who have likewise filed their COCs and CONANs are prohibited from doing the same and mandated to resign or give up their appointive positions.” Teresa Tavares
