MANILA, Philippines – BINALAAN ng Office of the Ombudsman si Maria Marcy Cosare-Ballesteros na mahaharap ito sa mas mabigat na kaparusahan kapag naulit pa ang katulad na reklamong kinaharap nito kung saan ang naging hatol ay “simple neglect of duty,” at multang katumbas ng kanyang tatlong buwang sahod.
Ito ay matapos idismis ng Ombudsman ang naunang reklamo na Grave Misconduct, Gross Neglect of Duty, Serious Dishonesty, Oppression at Conduct Prejudicial to the Best Interest of the Service na inihain laban kay Ballesteros nina Atty. Julius P. Alegrado at Erick Jan R. Macapagal.
“Respondent is further warned that a repetition of the same or a similar incident in the future will be dealt more severely by this Office,” ayon pa rin sa desisyon ng Ombudsman.
Si Ballesteros na Executive Director ng Career Executive Service Board ay inireklamo nina
Alegrado at Macapagal, parehong Director III ng CESB, sa Ombudsman dahil sa pagpapagamit nito ng government vehicle na Nissan Urvan na may conduction sticker na OW 7896 patungong Tagaytay noong May 14, 2022 para sakyan ng CESB personnel na dumalo sa kasal ni Ballesteros.
Batay sa testimonya ni Alegrado, tumanggi siyang sumakay sa nabanggit na sasakyan na paso o expired ang LTO registration sa kabila ng imbitasyon nina Ballesteros at ni Finance and Administrative Division Chief Jocelyn P. Lachica.
Sa biyahe ay nasangkot sa aksidente ang CESB vehicle sa isang Toyota Hiace Commuter Van na may plakang DAP 7949 sa kahabaan ng SLEX na sakop ng San Pedro Laguna na siyang nag-udyok kay Ballesteros noong May 19, 2022 na pakiusapan si Alegrado na burahin ang kanyang Facebook post
ukol sa kasal at mga larawan ng pagdalo ng CESB personnel.
Bagama’t nadismis ang mga reklamo nina Alegrado at Macapagal laban kay Ballesteros ay ipinag-utos naman ng Ombudsman na mabigyan ng kopya ng desisyon at reklamo ang Field Investigation Office ng Ombudsman para sa kinakailangan fact-finding investigation sa mga gumamit ng Nissan Urvan ng CESD personnel na dumalo sa kasal ni Ballesteros noong May 14, 2022.
“She is therefore meted the penalty of fine equivalent to her salary for three (3) months in lieu of suspension for three (3) months, line with Section 52, paragraph (a) and 54 paragraph (b), Rule 10 of 2017 Rules on Administrative Cases in the Civil Service payable to the Office of the Ombudsman, may be deducted from her retirement benefits, accrued leave credits or any receivable from her office.
Binigyan din ng direktiba ang chairperson na agad magsumite sa Central Records Division ng Ombudsman sa loob ng limang araw matapos matanggap ang desisyon ng written report kaugnay sa ginawang aksyon nito.
“The CESB Chairperson is hereby directed to implement this Decision and to ensure that a copy thereof is included in Ballesteros’ 201-File. She is likewise directed to submit to this office through Central records Division, office of the Ombudsman, within five (5) days from receipt hereof, a written report of the action taken hereon.” Meliza Maluntag
