MANILA, Philippines – Anumang pagbabago na gagawin ng Senado sa iskedyul ng impeachment trial ni Vice President Sara Duterte ay hindi ito dapat huli kundi mas paagahin, ayon kay House lead prosecutor at Batangas Rep. Gerville Luistro.
“Let us remember that the mandate of the Constitution that is to be forthwith is not only with respect to the convening of the impeachment court. It says, ‘trial forthwith’,” pahayag ni Luistro sa isang press conference.
“In other words, by trial, we mean presentation of evidence, presentation of witnesses. If ever there will be changes to July 6, it should be earlier and not later,” dagdag pa nito.
Inilabas ni Luistro ang pahayag sa gitna ng mga ulat na nagkakaroon ng talakayan sa Senado hinggil sa muling pagbuhay sa imbestigasyon sa flood control controversy, na nagdulot ng mga katanungan kung maaapektuhan ba nito ang kalendaryo ng impeachment.
Gayunpaman, sinabi ng mambabatas na nananatiling nakatutok ang 11-member prosecution panel sa pagtupad ng kanilang tungkulin sa ilalim ng Saligang Batas at handa silang sumalang sa oras na magtakda ng pinal na petsa ang Senate impeachment court.
“Of course there are always apprehensions, but nonetheless, liwanagin natin. Ang constitutional duty ng House is to present the evidence,” ani Luistro.
Bilang isa sa mga naging public prosecutor sa unang tangka ng impeachment laban sa bise presidente noong 19th Congress, inamin ni Luistro na nagmumula ang kanyang pangamba sa posibilidad na muling maderetsong maantala ang proseso sa pamamagitan ng mga procedural move, gaya ng pagre-remand at tuluyang pag-archive sa mga articles of impeachment.
“”We’re acknowledging the possibility. But we are more inclined to be more positive and forward looking this time dahil nagconvene naman ang impeachment court. They’re considering some dates about pre-trial conference and trial, so we wanted to believe na tuloy-tuloy na ito,” saad ng mambabatas.
Umaasa rin ang lead prosecutor na matutuloy ang mga petsang lumabas sa media ang Hunyo 15 para sa pre-trial conference at Hulyo 6 para sa pormal na simula ng paglilitis.
“We look forward na sana itong mga dates na lumalabas sa media, the June 15 pre-trial conference, the July 6 first schedule of trial, sana magtuloy-tuloy na because this is what the constitutional mandate provides,” ayon kay Luistro.
Bagamat may mga lumalabas nang petsa, nilinaw ni Luistro na wala pang natatanggap na opisyal na abiso ang prosecution panel mula sa Senate impeachment court.
“Regardless of the timeline na naririto, I am more concerned about the official notice which we are supposed to receive from the impeachment court. To this date, wala pa po kaming natatanggap na official notice,”pahayag n Luistro.
Gayunpaman, nanindigan si Luistro na kung may babaguhin man sa Hulyo 6 na target date, dapat ay mas maaga ito at hindi pwedeng maantala. Gail Mendoza
