MANILA, Philippines – Pinagtibay ng Sandiganbayan Fifth Division nitong Huwebes, Oktubre 1, ang resolusyon nito na tumatanggi sa hirit ni Uswag Ilonggo Rep. Jojo Ang na pagsama-samahin ang lahat ng 14 graft cases nito.
Si Ang ay inireklamo kaugnay sa pagkapanalo ng P214 milyon ng construction firm sa Public Works contracts habang siya ay nakaupo pa bilang partylist-representative.
Batay sa resolusyon na may petsang Oktubre 1, sinabi ng korte na iginigiit nito ang resolusyon noong Setyembre 9 na tumatanggi sa mosyon ni Ang.
“In the assailed Resolution, this court held that although all fourteen criminal charges stem from a single Ombudsman Resolution, each involve a distinct public infrastructure project with its own unique contract, procurement process, and financial records, requiring the court to evaluate liability on a per-project basis rather than collectively,” ayon sa korte.
Sa pinakabagong resolusyon, iginiit ng korte na “although the cases appear similar in nature, it is proper to try them separately and deny consolidation to give each case the attention it requires and prevent delay.”
Dagdag pa, sinabi ng korte na si Ang ay nakapagsagawa ng “a fatal procedural misstep” sa hindi paghahain ng motion for consolidation sa Second Division, na humahawak sa pinakamababang docket number sa lahat ng 14 kaso nito.
“After a careful review of Ang’s arguments, the court finds no compelling reason to depart from its ruling,” saad sa ruling.
Dagdag pa ng korte na, “the consolidation of cases is addressed to the sound discretion of judges.”
Sa ngayon, apat sa 14 kaso ni Ang ang naka-consolidate sa Second Division. RNT/JGC
