“The petition is fatally premature and warrants no Temporary Restraining Order or Status Quo Ante Order because the September 23 pro hac vice ruling excludes no one by itself, requests by detained senators to participate remain pending, and the voting denominator may never shrink at all,” ani Tongol.

“The impeachment court did not amend the Constitution. It simply ensured that the verdict will be decided strictly by the senator-judges who actually heard the evidence, rather than allowing absent or detained senators who never participated in the trial to cast an artificial vote of acquittal,” diin ni Tongol.

“There can be no grave abuse of discretion when a constitutional tribunal hears both the prosecution and the respondent, consults four retired Supreme Court jurists appointed as amici curiae with the parties’ agreement, and resolved the issue by an open, recorded vote,” ani Tongol.

RNT/MDS
