MANILA, Philippines — Tinututulan ng mga mamamahayag, akademiko, civil society groups at digital rights advocates ang mga panukalang anti-disinformation law na maaaring magpataw ng pagkakakulong at magbigay sa pamahalaan ng kapangyarihang magpatanggal ng social media posts.
Humigit-kumulang 50 kinatawan mula sa media, technology groups, academe at civil society ang nagtipon sa University of the Philippines College of Media and Communication noong Sabado, Hulyo 25, upang bumuo ng mga hakbang laban sa mga panukala.
Ang House Bill No. 9465, na inakda ni Ilocos Sur Rep. Sandro Marcos at iba pang mambabatas, ay naghihintay ng aksiyon sa counterpart measure sa Senado. Kabilang din ito sa mga priority bill na inendorso ng Legislative-Executive Development Advisory Council.
Ayon kay Carlo Nazareno ng Democracy.net.ph, may parusang anim hanggang 12 taong pagkakakulong ang House bill, habang maaari pang tumaas ang parusa kung media personality ang akusado.
“If the accused is a media personality, it is considered an aggravating circumstance, which entails increased penalties, potentially leading to a chilling effect for journalists. While the lower house bill takes many cues from the European Union’s Digital Services Act, which seeks to hold platforms to account, a provision was inserted which gives platforms a liability shield, which runs counter to the DSA,” sinabi ni Nazareno.
Dagdag niya, isinusulong naman sa Senate version ang paglikha ng Digital Media Integrity Council na bubuuin ng karamihan ay mga ahensiya ng executive branch, media organizations at online intermediaries. Bibigyan umano ito ng kapangyarihang magpatanggal ng content, bagama’t sinabi niyang pinasiyahan na ng Supreme Court na kailangan dito ang court order.
Sinabi ng Democracy.net.ph at SIGLA Research Center na kinikilala nila ang pinsalang dulot ng disinformation, ngunit nagbabala na maaaring malagay sa panganib ang digital rights at malayang pagpapahayag nang hindi naman natutugunan ang ugat ng problema.
“This is by no means a minimization of the harms that it causes, because among our ranks, you have people that see most palpably the harms that are caused by disinformation… But we realize that the costs far outweigh the benefits,” sinabi ni Justin Felip Daduya ng SIGLA.
“The threat to our digital rights, to our right to speech, it’s not worth a bill, especially if it can’t address the crisis in the first place… It settles for low-hanging fruit, but it leaves the roots of the disinformation crisis unscathed,” dagdag niya.
Ayon sa mga kritiko, pinarurusahan ng mga panukala ang mga indibidwal na social media user ngunit hindi napapanagot ang mga gumagawa ng sistematikong disinformation at ang mga platform. Nangangamba rin sila na maaaring humantong sa censorship ang takedown provisions at gawing “arbiter of truth” ang pamahalaan.
Sinabi ni dating Gabriela party-list Rep. Arlene Brosas na bukas sa iba’t ibang interpretasyon ang mga terminong reckless disregard, verifiable public harm at serious threat to national security, kaya maaaring gamitin ang mga ito sa politically motivated enforcement.
“There is a possibility that activists or individuals sharing politically sensitive posts could be subjected to red tagging or politically motivated prosecution before courts ultimately dismiss the cases. The bill does not sufficiently guarantee the independence of accredited researchers and fact-checkers,” sinabi niya.
Nagbabala rin si Brosas na ang pagkakakulong at multang aabot sa 6 percent ng Philippine annual gross revenue ng isang platform ay maaaring magtulak sa mga kumpanya na tanggalin maging ang lawful o borderline content.
Nauna namang sinabi ni House Speaker Faustino Dy III na maingat na binalangkas ang HB 9465 upang protektahan ang constitutional freedoms. Ayon sa Kamara, mataas ang pamantayan para sa criminal liability at protektado ang political criticism, satire, journalism, whistleblowing, academic discourse, artistic expression at religious expression.
