MANILA, Philippines – Mariing pinabulaanan ng Department of Foreign Affairs (DFA) ang pahayag ni dating Supreme Court Associate Justice Antonio Carpio na maaaring malagay sa panganib ang maritime zones at Exclusive Economic Zone (EEZ) ng Pilipinas sa ilalim ng Agreement on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction (BBNJ Agreement).
Sa inilabas na pahayag nitong Martes, sinabi ng DFA na nakabatay ang mga pahayag ni Carpio sa maling pagbasa sa kasunduan at sa pagkakalito sa pagitan ng high seas at EEZ na kapwa kinikilala sa ilalim ng United Nations Convention on the Law of the Sea (UNCLOS).
“This is not a matter of interpretation: the BBNJ Agreement explicitly and unambiguously excludes the maritime zones of coastal states from its scope, a fact apparent from even a cursory reading of both its title and text,” ayon sa DFA.
Iginiit ng departamento na ang EEZ ng Pilipinas ay protektado ng UNCLOS at hindi maaaring mabawasan o maapektuhan ng pagpapatupad ng BBNJ Agreement.
“The Philippines’ EEZ is defined and protected under UNCLOS—not by the BBNJ Agreement—and cannot be diminished, forfeited, or otherwise affected by the country’s implementation of the BBNJ Agreement,” dagdag nito.
Pinabulaanan din ng DFA ang pahayag ni Carpio na saklaw ng BBNJ Agreement ang migratory at straddling fish stocks, at nilinaw na saklaw ang mga ito ng hiwalay na UN Fish Stocks Agreement.
Kaugnay naman ng mungkahi ni Carpio na tutulan ang deklarasyon ng China sa kasunduan, sinabi ng DFA na hindi tahasang binabanggit ng naturang deklarasyon ang South China Sea at sariling interpretasyon lamang ni Carpio ang pag-uugnay rito.
Binigyang-diin din ng DFA na pinawalang-bisa na ng 2016 Arbitral Award ang nine-dash line claim ng China.
“More substantively, there is no longer any unresolved maritime dispute with respect to China’s sweeping claims in the South China Sea: the 2016 Arbitral Award conclusively held that China’s nine-dash line is incompatible with UNCLOS and carries no legal force,” ayon sa DFA.
Ipinagtanggol din ng departamento ang naging papel ng pamahalaan sa negosasyon ng BBNJ Agreement at sinabing nananatiling pangunahing konsiderasyon nito ang pambansang interes.
