Hiling na bawalan dumaong mga cargo ship sa Cebu South Harbor ibinasura ng korte

MANILA, Philippines – Ibinasura ng korte sa Cebu City ang petisyon ng cargo operator na Oriental Port & Allied Services Corp. (OPASCOR) na naglalayong bawalan ang mga cargo ship sa paggamit ng mga pasilidad ng Cebu South Harbor and Container Terminal Corp. (CSHCTC).

Sa walong pahinang kautusan na inisyu noong Setyembre 25, tinanggihan ni Presiding Judge Leah Geraldez ng Cebu City Regional Trial Court (RTC) Branch 20 ang prayer for temporary restraining order ng OPASCOR at preliminary injunction laban sa Cebu Port Authority (CPA) at CSHCTC.

“Wherefore, premises considered, OPASCOR’s application for the issuance of temporary restraining order and writ of preliminary injunction is hereby denied for lack of merit,” ayon sa korte.

Hinimok ng OPASCOR ang korte na bawalan ang CPA sa pagpayag sa mga barko na dumaong sa private port ng CSHCTC dahil sa umano’y regulatory violations at breaches sa permit ng terminal.

Sa kabila nito, sinabi ng korte na bigong ipakita ng OPASCOR ang “clear and unmistakable legal right” sa pag-oobliga ng judicial protection.

“Thus, OPASCOR has failed to establish the first requisite for the issuance of a writ of preliminary injunction,” sinabi ng korte.

“OPASCOR likewise failed to establish irreparable damage… Damages are irreparable within the meaning of the rule relative to the issuance of injunction where there is no standard by which their amount can be measured with reasonable accuracy,” dagdag pa.

“Lastly, the issuance of a writ of preliminary injunction would effectively result in the determination of the merits of this case before the holding of a full trial.” RNT/JGC
