MANILA, Philippines – Sa kabila ng confidentiality rule sa memorandum circular na ipinalabas ng Bureau Internal Revenue (BIR) sa kabuuan ng proseso sa iniimbestigahang pagbabayad ng buwis, ibinuyangyang ng defense team ni Vice President Sara Duterte ang kopya ng Letters of Authority (LOAs) nitong Biyernes.
Sa pagpapatuloy ng impeachment trial, ipinakita ng defense team ang mga kopya ng confidential LOAs ng BIR na inisyu kina Vice President Sara Duterte at sa asawa nitong si Atty. Manases Carpio.
Nangyari ito isang araw matapos tumutol ang depensa sa pagpapakita ng prosecution sa screen ng tax records nina Duterte at Carpio noong Huwebes, dahil sa isyu ng confidentiality at data privacy.
Sa direct examination noong Huwebes, kinumpirma ni BIR Chief of Staff Anne Loraine Garcia-Marquez na nag-isyu ang BIR ng LOA kay Duterte matapos itanong ni prosecution counsel Erwin Matib ang tungkol sa 2023 BIR Form 2316 na may pangalan ng bise presidente.
“We can only state whether or not may na-issue na LOA,” sabi ni Garcia-Marquez.
“But the details po, confidential po ito so I cannot disclose it in this court,” dagdag niya.
Ayon sa testigo, nakasaad sa form na tumanggap ng compensation income si Duterte mula sa Davao City government para sa taong iyon.
Nitong Biyernes, sa cross-examination, si defense counsel Kristine Ferrer na mismo ang nagpakita ng mga dokumento sa screen.
“Ma’am, the contents of the LOAs are confidential po ha, but you are the ones…” paalala ni Garcia-Marquez.
“Yes, we are the clients,” mabilis na sagot ni Ferrer.
“Your Honor, I think we want to put on record that it was the defense who put on the screen these LOAs, which according to them are supposed to be confidential,” sabi naman ni Matib.
“It’s just ironic for us, Your Honor, that they are flashing this, but it’s okay, Your Honor,” dagdag pa niya.
Napangiti si Presiding Officer Sen. Judge Francis “Chiz” Escudero at sinabi: “Strange things have happened, Atty. Erwin.” Pagkatapos ay inutusan niya si Ferrer na ituloy ang cross examination.
Sa pagtatanong, kinumpirma ni Garcia-Marquez ang mga detalye sa LOA.
Ang LOA kay Duterte ay may petsang Abril 29, 2026 at sumasaklaw sa lahat ng internal revenue taxes mula Enero 1, 2006 hanggang Disyembre 31, 2025 o 20 taon.
Ang LOA naman kay Carpio ay may petsa ding Abril 29, 2026 at sumasaklaw mula Enero 1, 2014 hanggang Disyembre 31, 2025. Parehong LOA ay sumasaklaw sa income tax at iba pang buwis, ayon kay Ferrer.
Tinanong din ni Ferrer ang proseso matapos ma-issue ang LOA, kabilang ang 180-day period para sa tax audit. Base sa petsa ng resibo na Mayo 29, 2026, sinabi ni Ferrer na posibleng magtapos ang audit sa Nobyembre 25, 2026.
Nang tanungin kung may notice of discrepancy na ba naisyu kay Duterte, sinabi ni Garcia-Marquez na alam niya ang sagot pero hindi ito maaaring ibunyag dahil “confidential” pa rin ang detalye ng imbestigasyon. Ernie Reyes
