Leviste, kailangang sumuko bago makapagpiyansa – DOJ

MANILA, Philippines – Kailangang sumailalim muna sa hurisdiksyon ng korte si Batangas Rep. Leandro Leviste bago siya makapagpiyansa, ayon kay Justice spokesperson Polo Martinez nitong Miyerkules.

Ito ay kasunod ng pag-isyu ng Makati court ng arrest warrant laban kay Leviste dahil sa umano’y paglabag sa Public Service Act.

“As a general rule, an accused must first submit to the jurisdiction of the court, either through arrest or voluntary surrender, before bail may be granted,” ani Martinez.

“Thus, if the accused is abroad, he would have to submit himself to the jurisdiction of the court before he may avail himself of bail,” dagdag niya.

Ayon sa Department of Justice (DOJ), itinakda sa P72,000 ang piyansa para kay Leviste.

Nasa France si Leviste upang alagaan ang kanyang inang si Sen. Loren Legarda na naka-medical leave, ayon sa kanyang tagapagsalita noong Setyembre 25.

Samantala, sinabi ni Martinez na maaga pa upang sabihin kung may gagawing aksyon kaugnay sa passport ni Leviste.

“Under the New Philippine Passport Act, there are specific grounds for the cancellation of a passport, including when the holder has been convicted of a criminal offense or has been declared a fugitive from justice, in both cases upon order of the court,” paliwanag niya.

“Neither circumstance is present at this time,” dagdag ni Martinez.

Ayon sa DOJ, nag-ugat ang kaso sa finding ng prima facie evidence na may reasonable certainty of conviction na sadyang pinabayaan at nabigong tuparin ng SPSBC ang mga obligasyon nito sa ilalim ng legislative franchise nito.

Nauna nang sinabi ni Leviste na walang basehan ang mga alegasyon ng Department of Energy laban sa kanya at banta ito sa mga public entity, kabilang ang mga media organization.

“The only complaint I’ve seen is from the media, and based on that, I can say: super duper hina,” ani Leviste.

Sinabi rin ni Leviste na maaaring magsilbi itong precedent para sa mga susunod na administrasyon na magsampa ng mga reklamong aniya’y nuisance complaints laban sa mga opisyal at direktor ng public utilities sa bansa. RNT/MDS/Jocelyn Tabangcura-Domenden
