MANILA, Philippines – Ipinag-utos ng House Committee on Justice nitong Miyerkules ang pagpapalabas ng subpoena laban sa ilang indibidwal, kabilang si self-confessed bagman Ramil Madriaga at ang abogado ni Vice President Sara Duterte na si Michael Poa, kasabay ng pormal na pagsisimula ng pagdinig sa mga impeachment complaint laban sa bise presidente.
Ayon kay committee chairperson Gerville Luistro, inaprubahan din ng panel ang hiling na protective custody para kay Madriaga at inaasahang haharap ito sa susunod na pagdinig sa Abril 14.
“We also acted in favor of the request for protective custody of witness Ramil Madriaga. We are also issuing subpoena ad testificandum to certain witnesses named by Congresswoman De Lima, ‘no? Among those witnesses, of course, is Ramil Madriaga. So we expect to hear his testimony on our next hearing that will be on April 14,” pahayag ni Luistro sa press conference matapos ang pulong.
Makikipag-ugnayan umano ang komite sa Bureau of Jail Management and Penology at sa korte na nag-utos ng pagkakadetine ni Madriaga kaugnay ng pagharap nito sa panel.
Tinutulan naman ni Cagayan de Oro 2nd District Representative Rufus Rodriguez ang mosyon para sa protective custody at tinawag si Madriaga na isang “polluted source” dahil nahaharap ito sa kasong kidnapping with murder. “Ramil Madriaga is a polluted source. He is facing kidnapping with murder charges,” ani Rodriguez.
Sumagot naman si ML party-list Representative Leila de Lima at sinabing “premature” pa para kwestiyunin ang kredibilidad ni Madriaga bago pa man ito makapagtestigo.
Inaprubahan din ng panel ang pagpapalabas ng subpoena kina Atty. Gloria Camora ng Commission on Audit Intelligence and Confidential Funds Audit Office, gayundin sa mga kinatawan ng Bureau of Internal Revenue at archives division ng House of Representatives.
Tinutulan din ni Rodriguez ang mosyon para sa subpoena duces tecum na humihingi ng statements of assets, liabilities, and net worth o SALN ni Duterte, at tinawag itong isang “fishing expedition.” “The second one, it is a fishing expedition. It is not– there are no ultimate facts on the SALN of the vice president. So I will vote no. I will object to the second one,” ani Rodriguez. Gayunman, inaprubahan pa rin ito ng komite.
Nag-utos din ang panel ng subpoena para sa records ng National Bureau of Investigation kaugnay ng imbestigasyon nito sa mga banta ni Duterte laban kina Pangulong Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos, at dating House speaker Martin Romualdez; income tax returns ng bise presidente, kanyang asawa, at mga negosyong iniuugnay sa kanila; at certification mula sa Philippine Statistics Authority hinggil sa mga tumanggap ng confidential funds ng Office of the Vice President at Department of Education.
Hindi dumalo si Vice President Duterte sa pagdinig sa kabila ng nakahandang nameplate para sa kanya sa venue.
Sinabi ni Luistro na may kaakibat itong usaping konstitusyonal at binanggit ang dating impeachment case laban kay dating Chief Justice Maria Lourdes Sereno.
Samantala, kinuwestiyon ni Bagong Henerasyon party-list Representative Robert Nazal kung wasto bang paggamit ng oras at resources ng Kamara ang naturang pagdinig at iginiit na dapat na itong iakyat sa plenaryo para maendorso sa Senado.
Nagsumite naman ang mga abogado ni Duterte ng liham na nagsasabing walang hurisdiksiyon ang komite para magsagawa ng tinawag nilang “mini trial,” ayon kay Bicol Saro party-list Representative Terry Ridon.
Tinuligsa ito ni Ridon at sinabing, “I will read the main basis for their objection to attending today. ‘Under these circumstances and considering the public statements made by the chairperson, it appears that the committee intends to conduct a trial’…This particular position of the counsels and of the vice president herself is basically a legal word salad. Ibigsabihin po wala po itong batayan sa katotohanan. Ito po ay legal na pagpapalusot para lusutan na namang mong muli ang pagpapanagot sa impeachable offenses laban sa atin pong pangalawang pangulo,” ani Ridon.
