Mga bangko, obligadong mag ulat ng kahina-hinalang transaksyon – AMLC exec

MANILA, Philippines – Kailangang mag-ulat ang mga bangko at iba pang covered institution ng mga transaksiyong may kahina-hinalang kalagayan, anuman ang halaga nito, ayon kay Anti-Money Laundering Council (AMLC) Secretariat Executive Director Atty. Ronel Buenaventura sa pagpapatulo ng impeachment trial.

Nilinaw ito ni Buenaventura sa cross-examination sa impeachment trial ni Vice President Sara Duterte, matapos ilarawan ni defense counsel Atty. Mark Vinluan ang mga financial institution bilang “encouraged” lamang na mag-ulat ng suspicious transaction kahit wala pang pinal na findings.

Tinutulan ni private prosecutor Atty. Mae Divinagracia ang pagpili ng salita ni Vinluan.

“Covered institutions are required to report suspicious transactions. They are not just encouraged to report suspicious transactions,” ani Divinagracia.

Kinumpirma ni Buenaventura na “required” ang salitang ginamit sa Anti-Money Laundering Act (AMLA) at sa implementing rules nito.

“The law used the word ‘required,’ Your Honor. So they’re required to report suspicious transactions, Your Honor,” sabi niya.

Ayon kay Buenaventura, ginagamit ng bangko o reporting institution ang impormasyon nito tungkol sa customer at sa transaksiyon para matukoy kung may suspicious circumstance. Gail Mendoza
