MANILA, Philippines – Tinawag ni Lanao del Sur Rep. Zia Alonto Adiong na “litmus test” ang mga petisyon sa Supreme Court (SC) na kumukuwestiyon sa bagong voting rule ng Senate impeachment court sa paglilitis kay Vice President Sara Duterte.
“It’s a litmus test because I believe the Constitution is very expressive, explicit on how we can actually act on accountability mechanism of the Constitution in running after those who are alleged to be violating or has already violated the Constitution,” ani Adiong.
Ang mga petisyon ay kumukuwestiyon sa desisyon ng impeachment court na alisin ang fixed na 16-vote threshold para sa conviction at gamitin ang two-thirds vote batay sa mga senador na legal at aktuwal na maaaring lumahok sa oras ng pagboto.
Bumoto ang impeachment court ng 13-1, habang anim na senator-judges ang hindi lumahok sa botohan. Ayon kay Adiong, bago ang ganitong sitwasyon dahil may mga nakaupong senador na maaaring hindi legal na makalahok sa impeachment trial.
“And even the framers of the Constitution did not anticipate that such circumstance might happen,” dagdag niya.
Binanggit ni Adiong ang magkakaibang interpretasyon ng mga retiradong Supreme Court justices na nagsilbing amici curiae. Sina dating Chief Justices Artemio Panganiban, Reynato Puno at Hilario Davide Jr. ay nagbigay ng interpretasyong maaaring hindi isama sa voting base ang mga senador na legal o aktuwal na hindi makalahok.
Samantala, iginiit ni retired Associate Justice Adolfo Azcuna na dapat manatili sa buong 24 na miyembro ng Senado ang basehan ng boto.
Binanggit din ni Adiong ang 1949 ruling sa Avelino v. Cuenco, na tumalakay sa pagkukuwenta ng Senate quorum, bagama’t kinilala niyang iba ang usapin nito kumpara sa voting threshold sa impeachment trial.
“Anybody can go to the Supreme Court because this is a free country,” ani Adiong.
Para kay Adiong, maaaring maaga pa ang kontrobersiya hangga’t hindi aktuwal na bumoboto ang impeachment court sa guilt o innocence ni Duterte.
“But I think the controversy, if you ask me, the controversy should begin when there is an actual voting when, for example, the Senate will reach its final verdict,” aniya.
Gayunman, sinabi niyang nasa prerogative ng mga petitioner ang paghingi ng mas maagang resolusyon mula sa SC. Ang mga petisyon sa voting threshold ay kasalukuyang nasa SC. RNT/MDS
