MANILA, Philippines – Dapat na pisikal na naroroon ang mga Senator-judge sa gaganaping impeachment trial laban kay Vice President Sara Duterte, partikular na sa oras ng botohan, ayon kay Tingog Partylist Rep at House Committee on Higher and Technical Education chairman Jude Acidre.
Paliwanag ng mambabatas ang bigat ng pagpapasya sa kapalaran ng ikalawang pinakamataas na opisyal ng bansa ay nangangailangan ng buong atensyon, direktang pag-obserba sa mga saksi, at personal na pananagutan sa loob ng Senate impeachment court.
Ang pahayag ay ginawa ni Acidre kasunod ng mainit na banggayan ng mga senador ukol sa panukalang payagan ang “remote participation” o online na pagdalo sa mga proceedings ng Senado.
“The more critical level of participation is voting. Even in the House, voting online is not really encouraged,” pahayag ni Acidre.
“In fact, you have to be physically present as the rules would require for you to vote in any measure. So much more for the impeachment of the Vice President,” giit pa ng mambabatas.
Para kay Acidre, ang pisikal na pagdalo ay hindi lamang isang teknikal na pormalidad. Aniya, kailangang marinig, makita, at timbangin ng mga senator-judge ang mga testimonya sa isang paglilitis kung saan ang kredibilidad, tono, at kilos ng saksi ay kasinghalaga ng mga dokumentong isinusumite sa korte.
“I think the role of a senator judge, for that matter, requires full attention, probably even physical participation because when you’re a judge, you have to observe also the demeanor of the witnesses, the tone of the language, which I think would be impeded if one were to participate only online. I think the gravity of the role that they would have to play requires their physical presence,” paliwanag ni Acidre.
Direktang sinabi rin nito na hindi dapat idaan sa internet ang ganito kabigat na paglilitis.
“If at all, definitely not in an impeachment trial. I don’t think that possibility was ever considered in the drafting of the rules.”
Bagamat kinilala ng mambabatas na binago ng teknolohiya ang sistema ng pagtatrabaho sa mga institusyon, iba aniya ang kategorya ng impeachment dahil ito ay isang constitutional trial at hindi pangkaraniwang routine legislative vote lamang.
“Of course, we have to accept that the higher levels of technology have kind of changed the way we do work. But for a matter as grave and as important as the impeachment of the second highest official of the land, I think there is no substitute to physical presence, especially during the voting,” dagdag pa ni Acidre.
Nilinaw naman ni Acidre na hindi didiktahan ng Kamara ang Senado sa magiging pasya nito, ngunit ang papel ng mga prosecutor mula sa Kamara ay itulak ang Articles of Impeachment at hayaan ang Senado na gampanan ang kanilang tungkulin sa ilalim ng Konstitusyon.
“I don’t want to get ahead of the Senate. They have a role to play. Ours is to defend the case. Ours is to defend the role of the prosecutor is to pursue the articles of impeachment,” ani Acidre.
Sa huli, sinabi ng mambabatas na mas mapagsisilbihan ang bansa kung diringgin ng Senado ang kaso nang buo, patas, at walang mga shortcut sa proseso na maaaring magdala ng duda sa magiging resulta. Gail Mendoza
