MANILA, Philippines – Kinwestyon ng kampo ni Jay Sonza nitong Biyernes, Mayo 1, ang pag-iisyu ng non-bailable warrant at sinabing ito ay “highly irregular” para sa minor offense ng unlawful publication.
Si Sonza ay inaresto Huwebes ng gabi sa Quezon City sa umano’y pagpapakalat ng maling impormasyon kaugnay sa kalusugan ni Pangulong Ferdinand Marcos Jr.
Ayon sa abogado ni Sonza na si Atty. Mark Tolentino, ang reklamo laban sa TV host ay minor offense na may parusang arresto mayor o multa.
“Under prevailing rules and practice, this is ordinarily treated as a bailable offense, and in many instances, courts do not immediately issue a warrant of arrest but instead proceed by way of summons,” sinabi ni Tolentino sa panayam ng GMA News.
“Given this, the issuance of a non-bailable warrant is, with due respect, highly irregular and legally questionable,” dagdag pa.
Maghahain ng nararapat na mosyon ang kampo ni Sonza upang hamunin ang warrant sa Pasay Regional Trial Court (RTC) Branch 118, kabilang ang motion to recall o pag-quash sa warrant of arrest.
Hihingi rin sila ng paglilinaw sa tamang aplikasyon ng bail.
“We will also assert all available remedies to protect our client’s rights and ensure full compliance with due process,” aniya.
Nauna nang sinabi ng National Bureau of Investigation (NBI) na nag-isyu ng arrest warrant ang RTC laban kay Sonza sa ‘unlawful use of means of publication’ at ‘unlawful utterances’ sa ilalim ng Article 154 of the Revised Penal Code (RPC) ng Republic Act 10175 o Cybercrime Prevention Act of 2012.
Sinabi ng kampo ni Sonza na ang warrant umano ay may nakalagay na “non-bailable.”
Nang hingan ng komento ay sinabi ni NBI Director Melvin Matibag na korte na ang magdedesisyon kung makakapagpiyansa ang inarestong indibidwal.
