MANILA, Philippines – Hiniling ng Office of the Solicitor General (OSG) sa Korte Suprema na ibasura ang mga petisyon para sa writ of habeas corpus na inihain ng mga anak ni dating Pangulong Rodrigo Duterte, dahil hindi umano ito maipapatupad habang siya ay nasa labas ng bansa.
Sa memorandum na may petsang Enero 5, 2026, sinabi ng OSG na bagama’t ang habeas corpus ay isang extraordinary remedy upang suriin ang legalidad ng detensyon, hindi ito enforceable “extraterritorially.”
“The OSG also pointed out that the former President has actively participated in his defense before the ICC, indicating that his available legal remedies lie with the international tribunal rather than Philippine courts,” ayon sa OSG.
Hiniling din ng OSG sa Korte Suprema na pairalin ang judicial restraint, dahil ang pag-aresto at pagsuko kay Duterte ay may kinalaman sa foreign relations na saklaw ng Executive Branch.
“Although the Philippines had withdrawn from the Rome Statute, the OSG explained that the arrest and surrender were carried out through international police cooperation following the circulation of a diffusion notice for former President Duterte’s arrest,” dagdag nito.
Iginiit din ng OSG na kumilos ang pamahalaan alinsunod sa international law at Republic Act No. 9851, at iginalang ang mga karapatan ni Duterte sa buong proseso ng pag-aresto at pagsuko. RNT
