MANILA, Philippines – Kinwestyon ni Senator-elect Vicente “Tito” Sotto III ang hakbang ng Senado na ibalik sa Kamara ang articles of impeachment laban kay Vice President Sara Duterte.
Ani Sotto, dating Senate president, ang pag-remand o pagbabalik ng kaso sa Kamara sa 19th Congress ay “unnecessary” dahil ito ang naghain ng impeachment.
“The HOR of the 20th Congress is the proper body to be asked by the Senate Impeachment Court of the 20th Congress if they so desire,” sinabi ni Sotto.
“The better term is ratification of the articles of impeachment filed by the HOR (House of Representatives) of the 19th Congress. It can be by simple resolution,” dagdag pa ni Sotto.
“The plenary is not supreme, the Constitution is; and ultimately, the sovereign is—the People,” giit pa nito.
Aniya, ang deklarasyon ng unconstitutionality ay “exclusive domain of the Supreme Court, not the Senate or the impeachment court.”
Kasabay ng plenary session nitong Martes, nagmosyon si Senator Ronald “Bato” Dela Rosa na humihiling na ang verified impeachment complaint laban kay Duterte ay ibasura “in view of its constitutional infirmities and questions on the jurisdiction and authority of the 20th Congress.”
Ani Escudero, dapat ay mauna munang mag-convene ang impeachment court bago aksyunan ang mosyon na ibasura ang impeachment complaint.
Nang mag-convene na ang impeachment court, nag-debate naman ang mga senador sa mosyon ni Dela Rosa.
Dito na nagmosyon si Senator-judge Alan Peter Cayetano na amyendahan ang mosyon ni Dela Rosa at ibalik ang articles of impeachment sa Kamara nang hindi ibinabasura ang kaso.
Matapos nito, bilang presiding officer ng impeachment court ay nag-isyu ng writ of summons si Escudero kay Duterte at nagbibigay ng non-extendible period na 10 araw para sagutin ang summon. RNT/JGC
