MANILA, Philippines- Pinagtibay ng Supreme Court ang kautusan ng National Telecommunications Commission (NTC) na hindi kwalipikado ang Next Mobile, Inc., na ngayo’y NOW Telecom at iba pang kompanya na nag-apply para sa third-generation mobile communications technology o 3G radio frequency.
Sa desisyon na pinonente ni Senior Associate Justice Marivic M.V.F. Leonen, ibinasura ng SC ang petisyon na kumuwestyon sa kautusan ng NTC noong Dec. 28, 2005 at Aug. 28, 2008 kaugnay sa diskwalipikasyon ng Next Mobile.
Kabilang sa disqualified din na telecommunications firms ay ang Bayan Telecommunications (BayanTel), Multi-Media Telephony, Inc. (MTI), at AZ Communications, Inc.
Pinaboran din ng SC ang petisyon ng NTC laban sa 2010 ruling ng Court of Appeals (CA) na nag-atas sa telecommunications regulatory body na maglaan ng ika-lima at pinal na 3G slot sa BayanTel.
Sinabi ng SC na batay sa Public Telecommunications Policy Act of the Philippines, bahagi ng national policy na ilaan ang radio frequency spectrum sa service providers na epektibong gagamit nito upang matugunan ang pangangailangan ng publiko sa telecommunications service.
Ipinunto ng Korte na ang NTC ang pangunahing administrator ng public resource at may kapangyarihang sumuri ng mga aplikante para sa frequency spectrums.
“In view of its (NTC) expertise in technical matters, and institutional experience, its factual findings are entitled to great weight before this Court and will not be reversed ‘save upon a very clear showing of serious violation of law or of fraud, personal malice or wanton oppression.’”
Nagdesisyong idiskwalipika ang Next Mobile dahil sa hindi pa nito nababayaran na spectrum user fees (SUFs) at supervision and regulations fees (SRFs) na aabot sa kabuuang P135.6 million hanggang noong December 2005. Teresa Tavares
