MANILA, Philippines – Hiniling ni Ombudsman Samuel Martires sa Court of Appeals (CA) na ipawalang bisa na ang temporary restraining order (TRO) na ipinataw sa preventive suspension laban kay outgoing Cebu Governor Gwen Garcia.
Nakasaad sa inihaing mosyon ng Ombudsman na ipinatutupad na ang preventive suspension noon pang Abril 29 habang inilabas ng CA ang TRO nito lamang Mayo 15.
Ipinaalala ni Martires sa Appellate Court ang doktrina na hindi na maaaring pigilan ang isang aksyon na ipinatutupad na.
“But this Honorable Court closed its eyes to this very basic doctrine that “when the acts sought to be prevented by the injunction or prohibition have already been performed or completed prior to the filing of the injunction suit, nothing more can be enjoined or restrained… the court by mere issuance of the writ, can no longer stop or undo the act,” nakasaad sa mosyon.
Magugunita na Abril 29 pinatawan ng Ombudsman ng preventive suspension si Garcia ng anim na buwan dahil sa mga reklamo ng grave abuse of authority dahil sa ilegal umano na pagkakaloob ng special permit sa isang construction company.
sa kabila ng suspensyon, patuloy na sinuway ni Garcia ang kautusan ng Ombudsman at nakakuha pa ng TRO sa CA.
Kinontra ng Ombudsman ang naging basehan ng TRO na matitigil umano ang daloy ng serbisyo sa Cebu kapag nasuspinde si Garcia.
“The implementation of this preventive suspension order will impede public service strains credulity. To be sure, petitioner Garcia’s suspension will not disrupt the delivery of public services to the people of Cebu,” iginiit sa mosyon.
Nababahala din si Martires sa posibleng mapanganib na pamantayan na idudulot ng inilabas na TRO.
“… it (allows) petitioner Garcia to sidestep the preventive suspension sends a troubling message: that legitimate grievances and complaints of graft and corruption, properly brought before the Ombudsman, can be nullified by a provisional remedy issued in contravention of established rules and jurisprudence… it (erodes) the Ombudsman’s prosecutorial and investigative powers,” ani Martires.
