Petisyon sa pagpigil sa impeachment ni VP Sara inihain sa SC

MANILA, Philippines – Hiniling sa Supreme Court ng isa sa abugado ng mga Duterte na magpalabas ng Temporary Restraining Order at Writ of Preliminary Injunction para mapigilan ang impeachment proceeding kay Vice President Sara Duterte.

Nakasaad sa supplemental petition ni Atty Israelito Torreon na ang impeachment kay VP Sara ay “unconstitutional and procedurally defective trial.”

Iginiit ni Torreon ang tatlong pangunahing constitutional violation umano ng impeachment.

“Lack of formal jurisdiction of the Senate after the 19th Congress ends on June 30, 2025, the impossibility of conducting a full and fair trial within the few remaining session days, and the failure of the fourth impeachment complaint to comply with constitutional and procedural requirements, including valid verification by its signatories.”

Ipinunto sa petisyon na banta sa due process at constitutional order ang tila pagmadali sa impeachment proceeding gaya ng oathtaking ni Senate President Francis Escudero bilang presiding officer at ang mungkahi ni Senate Majority Leader Francis Tolentino na madaliin ang timeline ng pagdaraos ng trial.

“The Senate’s compressed schedule—proposing to end the trial in under 19 days—violates fundamental principles of due process. Impeachment is not a political shortcut; it is a constitutional mechanism that demands fairness, adherence to rules, and judicial accountability,” nakasaad sa petition.

Iginiit ng petitioner na sa ilalim ng doctrine of legislative discontinuity, hindi maaaring ipasa ng 19th Congress ang hurisdiksyon nito sa paparating na 20th Congress. TERESA TAVARES
