MANILA, Philippines – Nakadepende sa desisyon ng gobyerno ng Pilipinas ang anumang posibilidad ng pansamantalang paglaya at pagbabalik sa bansa ni dating Pangulong Rodrigo Duterte mula sa International Criminal Court (ICC) sa The Hague, ayon sa tagapagsalita ng tribunal.
Ayon kay ICC Spokesman Fadi El Abdallah, kailangang tanggapin ng Pilipinas ang mga teknikal na kondisyon upang isaalang-alang ng mga hukom ang kahilingan para sa interim release ni Duterte. Bagaman wala pang pormal na aplikasyon, sinabi ng lead counsel niyang si Nicholas Kaufman na maghahain sila ng petisyon sa tamang panahon.
“An interim release can be requested if there is a possibility to put in place measures and conditions to ensure that if a person is released, none of that would happen, and that this person will be brought again before the court if the judges order,” anang ICC spokesperson.
Ipinaliwanag pa ni El Abdallah na ang warrant of arrest ay iniisyu kapag pinaniniwalaan ng mga hukom na maaaring patuloy na lumalabag sa batas ang isang indibidwal, hindi makikipagtulungan sa korte, o maaaring magbanta sa imbestigasyon at mga saksi.
May opsyon si Duterte na pumili ng ibang bansa kung saan siya mananatili sakaling mapagbigyan ang kanyang interim release.
Ngunit ayon sa ICC, kailangang makipagkasundo ang isang estado sa mga itinakdang kondisyon bago aprubahan ang pansamantalang paglaya.
“Now as a matter of principle, the ICC can enter into general agreements for interim release or for other purposes with different states, but can also enter into ad hoc agreements with certain states for specific cases,” ani El Abdallah.
“The technical measures and conditions have to be decided on a case-by-case basis by the judges and have to be accepted by a certain State for it to be ordered by the judges,” paliwanag pa niya.
Iginiit pa niya ang kahalagahan ng comitment ng estado “to cooperate and will follow the conditions in connection with the interim release.”
“Does this country accept this release? If the court is ordering certain conditions and measures to be put in place to ensure that he will not be in contact with this or that, that he will not be threatening the investigation, that he will be brought again before the court when the judge is ordered, does the country accept these conditions and measures or not and so on,” giit pa ng ICC spokesperson sa GMA report.
Dinala si Duterte sa ICC Pre-Trial Chamber I noong Marso 14 para pormal na pakinggan ang mga akusasyon laban sa kanya. Nakatakda ang confirmation of charges hearing sa Setyembre 23, ngunit inaasahang magsusumite siya ng hiling para sa interim release bago ang nasabing petsa.
