MANILA, Philippines – Naaayon sa konstitusyon ang kasunduan ng Pilipinas at Estados Unidos hinggil sa mapayapang paggamit ng nuclear energy.
Ito ang nakasaad sa legal opinion ng Department of Justice (DOJ) batay sa kahilingan ng Department of Foreign Affairs (DFA).
Sa DOJ Opinion No. 18 s. 2024 na pirmado ni Justice Secretary Jesus Remulla, hindi balakid sa national laws ng Pilipinas ang “Agreement for Cooperation between the Government of the Republic of the Philippines and the Government of the USA concerning Peaceful Uses of Nuclear Energy,” o mas kilala bilang 123 Agreement.
Pinirmahan ang kasunduan nina Energy Secretary Raphael Lotilla at US Secretary of State Antony Blinken sa San Francisco, California nitong November 2023 habang idinaraos ang Asia Pacific Economic Cooperation (APEC) Summit.
Sa 123 Agreement, maaring magkaroon ng direktang palitan ng impormasyon, nuclear material, equipment at components ang US at Pilipinas.
Isa rin itong daan para sa posibleng nuclear power projects sa mga US provider.
Sinabi ni Remulla na naaayon ang 123 Agreement sa mga Republic Acts (RAs) gaya ng Atomic Energy Regulatory and Liability Act of 1968 (RA 5207), Strategic Trade Management Act of 2015 (RA 10697) at Anti-Terrorism Act of 2020 (RA 11479).
