MANILA, Philippines – Iniutos ng Makati Regional Trial Court-Branch 147 ang preservation ng mga assets ng Pastor Apollo Quiboloy para sa gobyerno. Saklaw ng 12-pahinang Asset Preservation Order ang 12 bank accounts, 37 real properties, at 25 sasakyan, kabilang ang dalawang firetruck, fuel tanker, at isang Cessna aircraft na nakapangalan kay Quiboloy at sa Executive Pastor ng Kingdom of Jesus Christ (TEP-KOJC).
Ayon sa korte, may “probable cause” na ilabas ang preservation order para maiwasan ang paglilipat o pagtatago ng mga ari-arian na maaaring maging hadlang sa magiging desisyon ng korte.
“Unless restrained, there could be an imminent certainty that the subject monetary instruments and properties will be removed, transferred, concealed or disposed of beyond the reach of law wherein a favorable judgment in this case may be ineffectual and rendering the efforts of petitioner futile,” ayon sa korte.
Dagdag pa ng tribunal, kahit nagpakita ng mga testigo si Quiboloy at KOJC tungkol sa tithes at love offerings, hindi ito sapat na patunay ng lehitimong kita.
“It has not been properly established that respondent TEP-KOJC has an independent and legitimate source of income.”
Ang Asset Preservation Order (APO) ay nagbabawal sa anumang transaksyon, paglilipat, o pagtatago ng mga ari-arian habang nasa proseso ng civil forfeiture proceedings.
“An APO is a provisional remedy aimed at preserving monetary instruments or properties in any way related to an unlawful activity or money laundering offense defined herein, during the pendency of civil forfeiture proceedings,” paglilinaw ng korte.
Si Quiboloy ay nahaharap sa kasong conspiracy sa sex trafficking gamit ang force, fraud at coercion, sex trafficking ng mga bata, at bulk cash smuggling. RNT/MND
