Ridon: AMLC confidentiality ‘di absolute

MANILA, Philippines – Hindi absolute ang confidentiality ng Anti-Money Laundering Council (AMLC), ayon kay House prosecutor Terry Ridon ng Bicol Saro party-list at iginiit na ang ahensya mismo ang nagpapakita ng financial information sa mga korte kung humihiling ng freeze orders.

Ani Ridon, ito ay nagpapahina sa argumento na ang confidentiality rules ay pumipigil sa mga rekord ng AMLC na ipresenta sa Senate impeachment court sa paglilitis kay Vice President Sara Duterte.

Ipinunto niya na ang AMLC ay palagiang nagbibigay ng impormasyon sa Court of Appeals kung humihiling ng kautusan na i-freeze ang mga asset ng mga pinaghihinalaang may kaugnayan sa unlawful activities.

“If the confidentiality were absolute, they wouldn’t be able to provide information to the court to have assets frozen, right?” ani Ridon.

“So in a similar situation, why shouldn’t the AMLC be able to provide information to the Senate impeachment court, which does not derive its authority from the judiciary but has its own authority under the 1987 Constitution?” dagdag pa niya.

Noong Agosto, nakakuha ang AMLC sa Court of Appeals ng freeze order sakop ang 55 bank accounts at apat na insurance policies na may kaugnayan sa isang mambabatas, construction company, at iba pang indibidwal sa umano’y paglabag sa Anti-Graft and Corrupt Practices Act.

Ipinunto ni Ridon ang mga probisyon na nagpapahintulot sa AMLC na makipagpalitan ng mga impormasyon sa iba pang ahensya ng pamahalaan.

Dahil dito, naniniwala siyang ang confidentiality requirement ay hindi maikokonsiderang absolute.

“That means if information can be exchanged with other offices, then the confidentiality is not absolute. Because when you exchange information, you are disclosing data, right?”

Ang isyu ay naging matunog sa impeachment trial sa paghiling ng prosekusyon na ipresenta ang AMLC records ni Duterte, asawa nitong si Atty. Manases Carpio, at mga kompanyang may kaugnayan sa kanila.

Noong Hulyo, pinagbigyan ng Senate impeachment court ang hiling ng prosekusyon na i-subpoena ang AMLC, bank at tax records matapos makitang ang mga dokumento ay prima facie relevant at materyal sa mga alegasyon sa ilalim ng Article II.
