MANILA, Philippines – KINOKONSIDERA ni dating Presidential Spokesperson Harry Roque ang posibilidad na maghain ng kaso sa European Court of Human Rights (ECHR) sa Strasbourg, France, kaugnay ng tinawag niyang “unjust at discriminatory imprisonment” ni dating Pangulong Rodrigo Roa Duterte, na ngayon ay 80 taong gulang.
Ayon kay Roque, isa sa mga legal traditions sa Europa, partikular sa The Netherlands, ay ang hindi na pagpapakulong sa mga taong may edad 80 pataas.
“In Europe, especially here in the Netherlands, there’s a rule—when you’re 80 years old, you don’t go to prison anymore. So why is Tatay Digong still behind bars? This is a clear violation of his right to equal protection of the laws,” pahayag ni Roque.
Dahil dito, plano niyang kumonsulta sa mga Dutch human rights lawyers upang igiit ang probisyon sa ilalim ng International Covenant on Civil and Political Rights at European Convention on Human Rights. Aniya, malinaw na kaso ito ng age-based discrimination.
“Why are Dutch citizens over 80 spared from jail time, but a former president—who happens to be Filipino—is in prison? If people similarly situated must be treated alike, then Duterte, now 80, should be released,” dagdag ni Roque.
Binanggit din ni Roque na ang legal na opsyon ni Duterte ay hindi limitado sa International Criminal Court (ICC), kung saan nahaharap ito sa mga kaso kaugnay ng umano’y extrajudicial killings sa ilalim ng kontrobersyal na war on drugs.
Giit niya, may mas malawak na international legal framework na maaaring gamitin upang ipaglaban ang karapatan ni Duterte habang siya ay nasa loob ng hurisdiksyon ng European territory.
Nagpahiwatig pa si Roque ng posibleng direktang paghahain ng kaso laban sa The Netherlands, aniya: “The European Human Rights Treaty applies to all individuals within the territory of a member state—including Tatay Digong. That right isn’t just for Europeans, it’s for anyone under their jurisdiction.”
