MANILA, Philippines – Inihain ang isang petisyon sa Korte Suprema na nananawagan na pilitin ang Senado na agarang mag-convene bilang isang impeachment court at simulan na ang paglilitis kay Vice President Sara Duterte.
Sa 22 pahinang petition for mandamus na inihain ni Atty. Catalino Generillo Jr., iginiit nito na hindi pinapayagan sa Konstitusyon na i-delay ng Senado ang tungkulin nito kasabay ng recess.
Ani Generillo, ang Senado ay may “inescapable constitutional duty to immediately constitute itself” bilang isang impeachment court matapos matanggap ang Articles of Impeachment mula sa Kamara.
Tinukoy din sa Article XI Section 3 ng Konstitusyon na ang Charter ay malinaw sa “definite periods of time” na magsagawa ng mga tiyak na aksyon kaugnay sa impeachment complaint.
Kabilang dito ang:
“In case the verified complaint or resolution of all Members of the House, the same shall constitute the Articles of Impeachment, and trial by the Senate shall forthwith proceed.”
Iginiit ni Generillo na binibigyang mandato ng Konstitusyon ang Senado “to act forthwith,” o agaran.
Hinimok sa petisyon ang SC na mag-isyu ng writ of mandamus na pumipilit sa Senado na mag-convene nang walang pagkaantala at simulan na ang public trial.
“In the final analysis, the Constitution does not allow the Senate to procrastinate during the period it is on recess whether it shall constitute itself into a[n] impeachment court and try the Vice President. If it were so, the framers of the Constitution wrote a useless provision. Woe to the so-called doctrine of supremacy of the Constitution,” ayon sa petisyon.
Ipinadala ang kopya ng petisyon kay Senate President Francis “Chiz” Escudero at sa Office of the Solicitor General.
Noong Pebrero 5 ay inimpeach ng Kamara si Duterte, sa 215 mambabatas na nag-eendorso ng reklamo.
Ang Articles of Impeachment ay ipinadala sa Senado sa kaparehong araw.
Sa kabila nito, sinabi ni Escudero na maaari lamang mag-convene ang Senado bilang isang impeachment court kapag ang Kongreso ay nasa sesyon na, o sa pagsisimula ng 20th Congress sa Hulyo. RNT/JGC
