MANILA, Philippines — Ibinalik nitong Martes sa Bureau of Internal Revenue ang sealed green box na naglalaman ng tax records ni Vice President Sara Duterte at ng kaniyang mister na si lawyer Manases Carpio, isang araw matapos iutos ng Senate impeachment court na ibalik ito nang hindi binubuksan.
Kinumpirma ni Senate Secretary and Clerk of the Impeachment Court Renato Bantug na papunta na ang sealed box sa Office of the BIR Commissioner.
Sa pagbubukas ng impeachment trial ni Duterte noong Lunes, iniutos ni Presiding Officer Francis “Chiz” Escudero na ibalik ang kahon sa BIR dahil hindi pa umano ito nasa custodia legis, o legal custody, ng impeachment court.
“This box was turned over to the Senate as part of the documents, including the Articles of Impeachment. However, the Court is not yet in custodia legis of this box given that there is no lawful order issued by the court for this box to be turned over to the Senate. Moreso that it is not yet offered in evidence, not even, as of yet, marked,” ani Escudero.
Sinabi ni Escudero na dapat ibalik ang kahon nang hindi binubuksan.
“The chair therefore orders that the BIR box—closed, sealed, and as it is received—be sent back to the BIR, without prejudice to any action that the court may take,” dagdag niya.
Nilinaw naman ni Escudero na maaari pa ring iutos ng impeachment court ang paglalabas ng mga rekord sa mga susunod na bahagi ng proceedings kung kinakailangan.
Nakapaloob sa sealed box ang income tax returns nina Duterte at Carpio, gayundin ang sa kanilang mga negosyo. Una itong isinumite sa House Committee on Justice ngunit hindi nabuksan bago ang Senate impeachment trial.
Sa pre-trial conference, hindi pumayag ang kampo ni Duterte na buksan at markahan ang kahon bilang ebidensiya, ngunit sinabi nitong papayag sila kung bubuksan ito sa isang executive session.
Tinutulan naman ng BIR ang pagbubukas ng kahon, batay sa National Internal Revenue Code na nagsasaad na maaari lamang ilabas ang income tax returns kung ang kahilingan ay in aid of legislation at dapat itong suriin sa executive session, hindi sa public hearing na dinadaluhan ng media. RNT
