MANILA, Philippines- Iniutos ng Supreme Court ang pagpapalaya sa dalawang Chinese nationals na hinatulan noong 2014 sa multi-billion drug case.
Sa 35 pahinang desisyon ng SC En Banc, binaligtad nito ang desisyon ng Court of Appeals at pinawalang-sala sina Robert Uy at James Go Ong alyas Willie Gan dahil sa umano’y kapalpakan ng mga umarestong pulis, ng prosekusyon at maging ng mababang korte.
“It is truly regrettable that the Court must acquit accused-appellant in the instant case and extend such acquittal to Willie Gan” nakasaad sa ruling ng SC.
Dahil dito, pinagsabihan ng Korte Surprema ang law enforcement agents at prosekusyon na mas maging maingat at huwag maging ignorante sa pagtugon sa itinatakda ng Sec. 21 ng Comprehensive Dangerous Drugs Act of 2002 (RA 9165).
Nag-ugat ang kaso sa pagkaaresto sa anim na miyembro umano ng isang drug syndicate noong 2003 sa Valenzuela na nag-deliver ng 9,384 kilo ng shabu at nakuhanan ng 119.080 kilo ng shabu at 111.200 kilo ng chloromethamphetamine hydrochloride na tinatayang aabot sa ₱1 bilyon ang halaga.
Ayon sa SC, bukod sa hindi pagsunod ng arresting officers sa mandatory requirements ng Comprehensive Dangerous Drugs Act of 2002, nabigo rin ang prosekusyon na patunayan ang element of possession.
“The pieces of evidence submitted in the instant case, such as the photographs taken of the warehouse, demonstrate an utter lack of care in complying with the requirements of the law. Instead of taking a photograph of the items siezed, the apprehending officers merrly saw fit to take a photograph of the operatives securing the specimens recovered inside the warehouse and the operatives together with the items inside the warehouse. This ignorance extends to the prosecution because the records are woefully bereft of any attempt on its part to even invoke justifiable circumstanves to excuse the failure of the law enforcement agent to even attempt to comply with the requirements of Sec 21 of RA 9165. The utter disregard of the law demonstrated by these actors is reprehensible,” dagdag ng SC.
Mas nakagagalit din anito ang kapalpakan ng RTC nang ipataw nito ang parusa na 12 taon pagkakulong lamang imbes na life imprisonement laban sa dalawa.
Dahil sa mga nakitang butas ng Korte Suprema, iniutos nito sa Bureau of Corrections na agad palayain sina Uy at Gan. Teresa Tavares
