MANILA, Philippines – Ayon sa Office of the Prosecutor sa International Criminal Court (ICC) na ang isang alok sa Defense team ni dating Pangulong Rodrigo Duterte ay “irrelevant” sa kanyang kahilingan para sa pre-trial release.
Sa isang kamakailang pagsasampa, iginiit ng prosekusyon na si G. Duterte ay nananatiling isang potensyal na panganib, at ang tagal ng kanyang pagkakakulong ay hindi hihigit sa mga alalahaning ito.
“The relevant test is whether the conditions set forth in article 58(1) of the Statute remain fulfilled. The Prosecution has demonstrated through multiple filings that Mr Duterte, if granted interim release, would be a flight risk, is likely to interfere with the proceedings, and may commit further crimes,” nakasaad sa dokumento.
“Mr Duterte’s interim detention for an [REDACTED] does not outweigh the serious risk he presents if granted interim release.”
Ang pagsasampa, na pinamagatang “Prosecution’s response to ‘Defence Notification’,” ay nagtutulak pabalik sa argumento ng depensa na ang patuloy na pagkulong ni G. Duterte ay labis na mahaba, na binabanggit ang mga pagkaantala na diumano’y dulot ng depensa mismo.
“The Defence has unnecessarily delayed the proceedings by waiting until five months after Mr Duterte’s initial appearance, following the deadline for the Prosecution’s pretrial disclosure, the Document Containing the Charges and the Pre-Confirmation Brief, to file its challenge regarding his fitness to stand trial,” paliwanag sa dokumento.
Itinuro ng prosekusyon ang kamakailang hamon ng depensa hinggil sa pagiging angkop ni G. Duterte na humarap sa paglilitis, na isinampa limang buwan pagkatapos ng kanyang unang pagharap.
“The Prosecution also notes that during these five months, Mr Duterte was apparently capable of, inter alia, providing his instruction to file the Defence’s challenge to jurisdiction and its request to disqualify two Judges of this Chamber,” ayon sa dokumento.
Ang tugon ng prosekusyon ay direktang sumasalungat sa kamakailang pag-aangkin ng depensa na ang kagalingan ni G. Duterte ay isang isyu mula pa noong una niyang pagpapakita.
Nabanggit din ng prosekusyon na ang depensa ay nagmungkahi na ng mga karagdagang hakbang na maaaring higit pang maantala ang mga paglilitis.
Pinapanatili iyon ng dokumento “given the significant delays caused by the Defence, it cannot now, in earnest, point to a potential delay to argue that the length of Mr Duterte’s pre-trial detention militates in favour of his release.”
Sa paghahain, mariing sinabi ng prosekusyon ang posisyon nito sa alok na pagpapalaya ni Duterte, na sinasabi ito “in no way lessens the risk he presents if granted interim release.”
