MANILA, Philippines – Ibinasura ng Commission on Elections (Comelec) ang election offense cases laban kina Pangulong Ferdinand R. Marcos Jr. at Vice President Sara Duterte kaugnay ng umano’y ilegal na campaign donations noong May 2022 national and local elections.
Ayon kay Comelec Chairperson George Garcia, nilinis ng Law Department ng komisyon ang dalawa dahil sa umiiral na doktrinang immunity from suit para sa mga matataas na opisyal ng estado.
“The doctrine called immunity from suit, that is related to what is called state immunity from suit. That is recognized as a principle that is stated in our Constitution,” ani Garcia.
“The president of the Philippines and also, based on the study of our Law Department, the vice president of the Republic of the Philippines, are representing the State. As such, there can be no suit filed against the state,” dagdag pa niya.
Ipinaliwanag ni Garcia na kung itutuloy ang mga kaso ay lalabag ang Comelec sa Konstitusyon.
“Complaints have been filed against them. If we act on them, we will violate their immunity from suit,” aniya.
Nilinaw din niya na hindi nangangahulugan ang desisyon na hindi na maaaring magsampa ng kaso laban sa dalawa matapos ang kanilang termino sa Hunyo 2028.
“During the period of their tenure as president and vice president, they are immune from suits. But, of course, outside or after that, they can face investigations or charges,” ayon kay Garcia.
Ang reklamo ay nag-ugat sa petisyon na inihain noong nakaraang buwan ng mga grupong pinangunahan ng election watchdog na Kontra Daya na humihiling ng preliminary investigation sa umano’y paglabag sa Omnibus Election Code.
Ayon sa mga petitioner, nakatanggap umano sina Marcos at Duterte ng ipinagbabawal na campaign donations mula sa mga government contractors na sina Rodolfo D. Hilot Jr., presidente ng Rudhil Construction Enterprises, Inc., at Glenn Y. Escandor, presidente ng ESDEVCO Realty Corp. at Genesis 88 Construction, Inc.
Batay sa Statements of Contributions and Expenditures (SOCE), nagbigay umano si Hilot ng PHP20 milyon kay Marcos, habang si Escandor naman ay nag-ambag ng PHP19.9 milyon sa kampanya ni Duterte noong 2022. RNT
