NAGLABAS ng pahayag ang Land Transportation Office na “traffic enforcers deployed by Local Government Units have no legal authority to confiscate the driver’s license of a motorist”.
Dagdag ng ahensya ” We are currently implementing MC 001- 2026 of the Department of Transportation which establish the policy that prohibits the confiscation of a driver’s license at the moment of apprehension.”
Pero sa kabilang panig sabi ng BACOOR CITY LGU “Its traffic enforcers are duly authorized to confiscate driver’s license of motorists who violate the traffic laws within the city under ordinance 11- 2019.
Sabi din ng Bacoor LGU “It is exempted from implementing a 2024 Supreme Court ruling that the Metropolitan Manila Development Authority has exclusive authority in enforcing traffic rules because Bacoor city is located outside Metro Manila.

SA kasong MMDA vs VIRON TRANSPORTATION, the local government and Metro Manila Traffic enforcers LACK INDEPENDENT STATUTORY POWER to confiscate driver’s licenses as the AUTHORITY VESTED in R.A. 4136 which is the LAND TRANSPORTATION AND TRAFFIC CODE OF THE PHILIPPINES.
Ibig sabihin maliban sa mga LGU sa Metro Manila, pwede magpasa at at magpatupad ang LGU ng sariling traffic ordinance pero hindi dapat saklawin ng ordinansa ang pagkumpiska ng lisensya dahil may national law na dito. At ang isang ordinansa ay hindi pwedeng maging mas mataas sa national laws.
Sa kasalukuyan ay may ipinatutupad din na DOTR no. 001- 2026 that prohibits physical on the spot license confiscation.
Ang problema kung sakali na mahuli ka sa Bacoor at kinumpiska lisensya mo ng enforcer nila ay igigiit nila ang ipinatutupad nilang ordinansa. Presumed valid kasi ito hangga’t hindi hinahamon sa husgado para ideklarang “null and void.” At kung ikaw ay simpleng motorista ay mag-aaksaya ka pa ba ng panahon at pera para magsampa sa husgado?
Mas mainam na magkaroon ng koordinasyon ang LTO, DOTR, DILG at LGU sa bagay na ito para hindi kawawa ang mga motorista. Pero kung talagang igigiit ng LGU ang pagkumpiska ng lIsensya handa ang mga abogado ng LCSP na alalayan ang mga motorista ng libre.
