Transport, commuters group nanawagan sa 6 LGU na ipagpaliban implementasyon ng NCAP

MANILA, Philippines – Hinimok ng transport at commuters’ groups ang anim na local government units (LGUs) ng Metro Manila na ipagpaliban at linawin muna ang pagbabalik ng no-contact apprehension policy (NCAP) bukas, Oktubre 5 dahil sa mga pangamba sa implementasyon, due process, at dagdag na gastos sa mga motorista.

Sakop ng polisiya ang Manila, Muntinlupa, Parañaque, Quezon City, San Juan at Valenzuela.

Hinimok ng transport group na Manibela ang LGU na ipagpaliban ang implementasyon dahil sa mataas na presyo ng produktong petrolyo at mga produkto at serbisyo.

“We are calling on all local government units (LGUs) implementing the NCAP to temporarily suspend its enforcement due to the ongoing oil crisis, with fuel prices remaining high,” saad sa pahayag ng Manibela.

“This is on top of the rising cost of goods and services, which is already placing a burden on motorists and the public,” dagdag pa.

Kinwestyon ng grupo ang posibleng kaugnayan ng private contractors at kung ang mga LGU ay magpapatupad ng mas mataas na penalty para mabawi ang gastos sa mga kagamitan sa NCAP.

Gumagamit ang NCAP ng CCTV at digital camera footage para tukuyin ang traffic violators, at ang citation tickets ay ipadadala sa mga may-ari ng sasakyan.

Hinimok din ng Lawyers for Commuters Safety and Protection (LCSP) ang mga LGU na konsultahin muna ang mga stakeholder bago ipatupad ang kani-kanilang NCAP systems.

Kinwestyon ng LCSP kung paano aangkop ang lokal na sistema sa uniform traffic-enforcement framework sa ilalim ng Metro Manila Traffic Code of 2023, at ang NCAP ay ipinatutupad na ng Metropolitan Manila Development Authority (MMDA).

Nangamba rin ang grupo sa due process at posibleng kaugnayan ng private contractors sa pagpapatakbo ng sistema.

“LGUs should first clarify whether the NCAP they are implementing involves a private contract provider that will earn from the fines paid by motorists,” ayon sa LCSP.

Ayon kay LCSP president Ariel Inton, ang NCAP ay maaaring “doing more harm than good” kung ang mga panuntunan at enforcement framework ay mananatiling hindi malinaw.

“We will implement something without fixing the framework of the rules. There are so many roads under construction, and experiencing floods right now, this is not the time to add hardships to our drivers,” sinabi ni Inton.

Nauna nang ibinasura ng Korte Suprema ang mga petisyon na humahamon sa mga ordinansa ng NCAP.

Sa kabila nito ay nilinaw ng korte na ang dismissal ay hindi nag-rule sa validity ng hinamong NCAP issuances at ang mga paghamon sa hinaharap ay posible pa ring ihain kung ang revised system ay magpataas sa aktwal na kontrobersiya.

“There needs to be a consultation with the stakeholders before the implementation of NCAP so that the system will be clear,” ayon sa Manibela. RNT/JGC
