MANILA, Philippines – Pinapayagan ang Anti-Money Laundering Council (AMLC) na magbahagi ng mga impormasyon sa foreign counterparts, na nagbibigay ng basehan para magbigay din ito ng financial records sa Senate impeachment court, ayon kay prosecution legal spokesperson at counsel Benjamin “Jay” Tolosa Jr. nitong Sabado, Oktubre 3.
Ito ang argumento ni Tolosa sa patuloy na pagkwestyon ng depensa sa confidentiality ng AMLC records na ipipresenta sa impeachment trial ni Vice President Sara Duterte.
Ipinunto niya na sa rules ng AMLC ay pinapayagan ang ahensya na makipagpalitan ng impormasyon sa foreign financial intelligence units at iba pang awtoridad sa mga kondisyon.
“As pointed out during the hearings, if the AMLC can share information even with foreign counterparts, then all the more can it share these documents with the constitutional institution that is the impeachment court,” ani Tolosa.
Sinabi pa niya na ang mga batas ay hindi nagpapatupad ng absolute prohibition na pipigil sa impeachment court sa pagpayag sa produksyon ng AMLC records.
“The reason is that, with respect to AMLC records, there is no absolute prohibition under the applicable laws that would prevent the impeachment court from issuing a subpoena to compel the presentation of these documents,” aniya.
