MANILA, Philippines – Ibinalik ng Bureau of Customs (BOC) ang polisiya nito na agarang nagsususpinde kahit sa unang offense pa lamang, sa mga tiwaling rehistradong brokers o importers.
Sa memorandum na may petsang Setyembre 5, ibinalik ni BOC Commissioner Ariel Nepomuceno ang Customs Memorandum Order 12-2021, o “Guidelines on the Imposition of Penalties relative to the Customs Accreditation of Importers and Brokers,” na nagtatakda ng grounds sa pagpapatupad ng preliminary suspension sa mga importer o broker.
Ipatutupad ang parusa sa kompanya kahit sa unang babala pa lamang, sa maximum na 90 araw kapag ang kargamento ay naglalaman ng ipinagbabawal o restricted na mga produkto na walang kaukulang permit o clearance; o kapag ang kargamento ay na-forfeit sa nagdaang taon sa paglabag sa mga probisyon ng Customs Modernization and Tariff Act (CMTA); at ang “other analogous circumstances at the discretion of the commissioner.”
Ang mga isasailalim sa suspensyon ay iisyuhan ng warrant of seizure and detention, isang kautusan na ipinapasa sa mga partido na ang ari-arian o kargamento ay napag-alamang illegal na dinala sa bansa.
Dahil dito, ang polisiya ng BOC sa Memorandum 06-2024, na pansamantalang nagpapatigil sa automatic preliminary suspension, hanggang walang administrative charge na naihahain laban sa importer o broker, ay wala nang bisa.
Ani Nepomuceno, ang hakbang na ito “restores the BOC’s full authority to act against accreditation violations while still providing mechanisms to ensure that legitimate shipments are not unduly hampered.”
Dagdag pa niya, “We want our stakeholders to see that the bureau is serious about balancing firm enforcement with due process.” RNT/JGC
