Bar exam score ng examinee, ‘di maaaring isiwalat nang walang permiso – SC

MANILA, Philippines – Hindi maaaring mailabas ang nakuhang score ng isang Bar taker nang walang pahintulot sa mismong examinee.

Inihayag ng Supreme Court (SC) na ang Bar examination scores ay itinuturing na sensitibong personal information sa ilalim ng Data Privacy Act.

Sa Bar Matter No. 4968, inaprubahan ng SC En Banc ang Guidelines on Requests for Disclosure of A Law School’s Bar Examinations Performance.

Sa ilalim ng naturang Guidelines, maaaring aprubahan ng SC ang kahilingan mula sa mga law schools para makuha ang Bar exam scores basta ang mga scores ay pinagsama-sama, averaged o hindi pinapakilala ang individual Bar exam taker.

“Permissible data includes the number or percentage of the law school’s graduates categorized by type (new examinees, previous takers, refreshers); the number or percentage of graduates within specific score ranges; the average score of all graduates in each Bar subject; and the overall average general weighted average for law schools with multiple
examinees. Additionally, anonymized scores of each Bar taker, with all identifiers removed, are also permitted.”

Ang mga nabanggit na impormasyon ay hindi itinuturing na personal information sa ilalim ng Republic Act No. 10173 o ang Data Privacy Act of 2012.

“Requests from law schools must be signed by the dean or an equivalent official, and must state a legitimate purpose, such as
reviewing and improving law degree programs and performance on future Bar exams.”

Ang Office of the Bar Confidant ang naatasan na mag-review at ymalsuon sa mga isinusumiteng requests ng mga law schools. TERESA TAVARES
