MANILA, Philippines – Duda si incoming Mamamayang Liberal Party-list Rep. Leila de Lima sa timing ng kautusan ng Office of the Ombudsman kay Vice President Sara Duterte na sumagot sa mga reklamong inihain ng Kamara sa umano’y maling paggamit ng confidential funds.
Nitong Biyernes, Hunyo 20, inatasan ng Ombudsman si Duterte, kasama ang siyam iba pang opisyal mula sa Office of the Vice President at Department of Education, na maghain ng kanilang counter-affidavits.
“There’s really room, and there’s reason for concern. Especially on the part of prosecutors, sa impeachment prosecutors,” ayon kay De Lima sa isang panayam.
Iginiit ni De Lima na si Ombudsman Samuel Martires na itinalaga ni dating Pangulong Rodrigo Duterte noong 2018, ay inaasahang magreretiro sa Hulyo.
Idinagdag pa niya na ang “swift action” ng Ombudsman sa kaso ni Duterte ay “out of character,” sa pagsasabing “slow pace in previous investigations involving former President Rodrigo Roa Duterte and his close associates.”
“That’s out of character, actually, if you can say that’s how quickly he acted to make VP Sara answer immediately,” ayon pa kay De Lima.
Ngayong buwan, tinanggap ng Kamara ang committee report na nagrerekomenda ng paghahain ng reklamo laban kay Duterte at iba pang opisyal mula sa kanyang opisina dahil sa maling paggamit ng confidential funds.
Ang mga reklamo ay technical malversation, falsification at paggamit ng falsified documents, perjury, bribery at corruption, at plunder, betrayal of public trust, culpable violation ng Constitution.
Ayon kay De Lima, ang mabilis na pagkilos ng Ombudsman ay maaaring makaapekto sa Senate impeachment court kaugnay sa impeachment trial ni Duterte.
Iginiit ng dating senador na sa oras na ibasura ng Ombudsman ang kaso ni Duterte bago mag-convene ang Senado bilang impeachment court ay magagamit ito ng defense team para pahinain ang prosecution’s case.
“The doubt won’t disappear, the suspicion that maybe the plan is that he will act immediately once he gets it, the counter-affidavit has been submitted, and it is not far to dismiss it,” ani De Lima.
“If that is dismissed, necessarily that would have an effect on the impeachment case at trial. That’s what the defense counsel will mention. There’s a finding of probable cause,” dagdag pa.
Si Duterte ay inimpeach ng Kamara noong Pebrero 5 matapos 215 mambabatas ang pumirma ng reklamo laban sa kanya sa kaparehong grounds kabilang ang “culpable violation of the Constitution, betrayal of public trust and graft and corruption.”
Nag-convene ang Senado bilang impeachment court noong Hunyo 10.
Sa kabila nito, ipinanukala ni Senator-Judge Alan Peter Cayetano ang mosyon na ibalik ang articles of impeachment sa Kamara upang masiguro na walang nilabag sa Konstitusyon at ang isyu ng hurisdiksyon.
May kabuuang 18 senator-judges ang bumoto pabor sa mosyon dahilan para i-remand ng impeachment court ang articles of impeachment sa mababang kapulungan.
Sina Senador Risa Hontiveros, Senate Minority Leader Aquilino “Koko” Pimentel III, at administration Senators Grace Poe, Nancy Binay, at Sherwin Gatchalian lamang ang tumutol dito. RNT/JGC
