MANILA, Philippines – SINAGOT na ni Vice President Sara Duterte ang dalawang kasong impeachment laban sa kanya bago ang itinakdang deadline ng Mababang Kapulungan ng Kongreso.
Sa kanyang 15-pahinang consolidated verified answer, tinutulan ni VP Sara ang mga reklamong inihain nina Fr. Joel Saballa at Atty. Nathaniel Cabrera, na nag-akusa sa kanya ng culpable violation of the Constitution at betrayal of public trust.
Sinabi ni Atty. Michael Poa, tagapagsalita ng depensa, kulang umano sa “ultimate facts” ang mga reklamo at nakabatay lamang sa haka-haka at konklusyon.
“We raised due process issues because of what we feel sa aming pananaw ay hindi naging uniform ‘yung standards ng pag-determine ng sufficiency in form and substance doon sa naging impeachment complaints laban sa ating Pangulo at sa naging impeachment complaints laban sa ating Ikalawang Pangulo,” ang sinabi ni Atty. Poa.
Subalit, sinabi ni Bicol Saro party-list Rep. Terry Ridon na hindi direktang sinagot ni VP Sara ang mga alegasyon laban sa kanya at sa halip ay kinuwestiyon lamang nito ang proseso ng impeachment.
Ang pahayag na ito ni Ridon ay matapos niyang mabasa ang sagot na isinumite ni VP Sara alas-4:30 ng hapon, araw ng Lunes, ang deadline ng paghahain nito ng sagot sa mga reklamo.
“The Vice President’s Answer Ad Cautelam fails to squarely address the allegations contained in the two impeachment complaints. Instead of responding directly to the charges, it attempts to challenge the impeachment proceedings themselves based on a confused interpretation of due process and the concept of ultimate facts in impeachment cases,” ayon kay Ridon.
Aniya pa, hindi totoo na pinagkaitan ng due process ng Kamara si VP Sara.
“In fact, she was afforded the opportunity to respond through this Answer Ad Cautelam. However, the submission does not specifically and completely rebut the material allegations raised in the complaints,” aniya pa rin.
Malinaw aniya na maklikita sa reklamo at mga dokumentong kalakip nito ang mga ultimate facts kaugnay ng maling paggamit ng confidential funds; pagbabanta sa buhay ni Pangulong Ferdinand Marcos Jr. First Lady Liza Araneta-Marcos, at dating Speaker Ferdinand Martin Romualdez; at ang hindi nito maipaliwanag na yaman at paglabag sa requirement ng Statement of Assets, Liabilities, and Net Worth (SALN).
Sa naging tugon naman ng kampo ni VP Sara, hiniling nito sa House justice panel na ibasura ang impeachment complaints laban sa Bise-Presidente, sabay sabing ang alegasyon laban kay VP Sara ay hindi impeachable offenses.
“The impeachment complaints brazenly accuse the Vice President of entering into a supposed ‘contract to kill’ yet they fail to present any shred of proof that any such contract ever existed,” ang nakasaad sa tugon ni VP Sara.
Sa video na tinukoy sa complaints, sinabi ni VP Sara na may kinontak na siyang tao na papatay kina Pangulong Ferdinand Marcos Jr., Unang Ginang Liza Araneta- Marcos at Leyte Rep. Ferdinand Martin G. Romualdez kung siya ay papatayin.
Ang naging tugon ni VP Sara na ang impeachment complainants ay bumatay lamang sa “exaggerated conclusions dressed up as fact.”
“Even worse, this conclusion is used as the basis for further unsupported assertions that the Vice President allegedly violated the Constitution, betrayed public trust, committed high crimes, and manifested a willful intent to subvert constitutional order, to incite or condone violence against constitutionally-vested officials, and to destabilize the lawful functioning of government,” ang nakasaad pa rin sa tugon.
“Allegations of such magnitude cannot be sustained by exaggeration and inference alone,” dagdag sa tugon.
Samantala, sinabi ng National Unity Party (NUP) na susuporta lamang sila sa impeachment kung may malinaw, tiyak, at corroborated na ebidensya, kabilang ang testimonya ng whistleblower na si Ramil Madriaga.
Binibigyang-diin ng NUP na ang impeachment ay hindi basta akusasyon, kundi isang constitutional case na dapat matibay sa harap ng buong paglilitis.
Nauna ng idineklara ng House Committee on Justice na sufficient in form at in substance ang dalawang nalalabing impeachment complaints laban kay VP Sara. KRIS JOSE
