MANILA, Philippines- Iginiit ng Pilipinas sa United Nations General Assembly (UNGA) ang karapatan nito sa Bajo de Masinloc (Scarborough Shoal) kasabay ng pag-akusa sa Tsina ng “gross distortion” sa UN Convention on the Law of the Sea (UNCLOS).
Sa 51st plenary meeting ng 79th session ng UNGA noong Disyembre 11 (Manila time), sinabi ni Philippine Permanent Representative to the UN in New York Antonio Lagdameo na ang Maynila ay may soberanya sa nasabing tampok.
“Bajo de Masinloc has always been an integral part of the territory of the Philippines,” aniya pa rin.
“Only the Philippines, in the exercise of its sovereignty, has the right to establish baselines, and the breadth of the territorial sea around Bajo de Masinloc, in line with the UNCLOS,” ang sinabi ni Lagdameo.
Ang pahayag na ito ni Lagdameo ay kasunod ng naging anunsyo ng Beijing ukol sa baselines nito sa paligid ng Bajo de Masinloc, na ayon kay Lagdameo ay lumabag sa UNCLOS at nagpahina sa rules-based international order.
Sa kabila ng regular na harassment na hinaharap ng Pilipinas sa loob ng maritime zones nito, sinabi ni Lagdameo na ang bansa “remains committed to diplomacy and other peaceful means to settle disputes”.
“We abide by the UN Charter and the Manila Declaration on the Peaceful Resolution of Disputes in asserting our sovereignty, sovereign rights and jurisdiction in the South China Sea,” giit niya.
Tinanggihan umano ng Manila ang mga salaysay ng Tsina na naglalarawan sa South China Sea bilang “theater of major power rivalry’ sabay sabing binabalewala nito ang “fundamental truth that all states as sovereigns have the right to determine their own destiny and to secure their own future”.
Inulit ng Pilipinas ang ilegal na paggamit ng Tsina sa straight baselines ay ilegal dahil ina-apply lamang umano ito sa lokalidad kung saan ang coastline ay “deeply indented and cut into, or if there is a fringe of islands along the coast in its immediate vicinity.”
“These conditions do not include the situation of Bajo de Masinloc in relation to China,” ang tinuran ni Lagdameo.
“It is not surprising for China to make a gross distortion of UNCLOS when in disregard of UNCLOS, it even falsely asserts a right to draw archipelagic baselines, even though it is not an archipelagic state,” patuloy ng opisyal.
Samantala, ang kalatas ay inihayag sa isinagawang UNGA debate hinggil sa “Oceans and Law of the Sea”, annual plenary agenda item na kinokonsidera ang developments na tumutukoy sa UNCLOS, at maging may kinalaman sa “’ocean affairs” o mga batas ng karagatan. Kris Jose
