MANILA, Philippines – Muling ibinasura ng Pilipinas nitong Martes, Agosto 4, ang inilabas na “management measures” ng China para sa Bajo de Masinloc at hiniling sa Beijing na bawiin ang mga ito at huwag ipatupad sa lugar.
Kabilang sa mga hakbang ng China ang pagbabawal sa pangingisda at pagpasok sa lugar “without prior approval,” kasunod ng unilateral na pagdeklara ng Beijing noong Setyembre 2025 sa bahura bilang national nature reserve.
“[T]he DFA has already issued a statement protesting the declaration by the China State Council of Bajo de Masinloc as a natural nature reserve,” pahayag ni Department of Foreign Affairs spokesperson for maritime affairs Rogelio Villanueva Jr.
“So, in the same manner, we reject this issuance of the different agencies from China, and we call on China to refrain from implementing any measure, to withdraw their issuances, and respect the Philippines’ sovereignty, sovereign rights and jurisdiction in accordance with international law, particularly the 2016 Arbitral Award,” dagdag niya.
Ayon sa state-run Xinhua News Agency, magkatuwang na inilabas ang mga patakaran ng Ministry of Natural Resources, National Forestry and Grassland Administration, China Coast Guard, at Hainan provincial government.
Ang Bajo de Masinloc, na kilala rin bilang Scarborough Shoal, ay matatagpuan humigit-kumulang 124 nautical miles mula sa mainland Zambales. Naninindigan ang Pilipinas na mayroon itong soberanya at hurisdiksiyon sa naturang lugar.
Noong Hulyo, pormal na idineposito ng pamahalaan sa United Nations ang opisyal na nautical chart ng Bajo de Masinloc at ng mga nakapaligid nitong maritime zones.
Sinabi ni Villanueva na nililinaw ng pagsusumite ang posisyon ng Pilipinas at nagsisilbing “valid exercise of Philippine sovereignty and jurisdiction” sa bahura.
“It serves as an official notice of the geographical extent of our applicable authority and jurisdiction. And, as we all know, it, of course, explains or conveys that the applicable principle is the use of normal baselines on Bajo de Masinloc,” aniya.
“And from there, we are able to project the maritime limits of Bajo de Masinloc and the legal status of the enforcement that we are going to undertake,” dagdag niya.
Isinagawa ang deposito alinsunod sa Article 16 ng 1982 United Nations Convention on the Law of the Sea, na nag-aatas sa mga coastal state na ilathala ang kanilang mga opisyal na chart o geographical coordinates ng mga baseline na ginagamit sa pagsukat ng territorial sea.
Sa ilalim ng Philippine Maritime Zones Act, UNCLOS, at 2016 South China Sea Arbitral Award, mayroon ang Bajo de Masinloc ng territorial sea na umaabot hanggang 12 nautical miles mula sa normal baselines nito at contiguous zone na mula 12 hanggang 24 nautical miles. RNT
