MANILA, Philippines- Nilinaw ng NOW Telecom Company Inc. nitong Martes na hindi pa ibinabasura ang petisyon nitong ipawalang-bisa ang circular ng National Telecommunications Commission (NTC) circular na naglalaman ng mga alituntunin sa pagpili ng bagong major player sa telecommunications industry ng bansa.
Sinabi ng NOW na hindi tinabla ng Korte Suprema ang hirit nitong ibasura ang Memorandum Circular (MC) No. 09-09-2018.
“NOW Telecom’s complaint to declare Memorandum Circular No. 09-09-2018 as unconstitutional and illegal remains pending before the Court of Appeals,” pahayag ng telecommunications conglomerate na pagmamay-ari ni Mel Velarde.
Nilalaman ng MC No. 09-09-2018 ang rules and regulations sa proseso ng pagpili para sa bagong major player sa telecommunications sector ng bansa.
Ang Mindanao Islamic Telephone Company Consortium, na ngayo’y DITO Telecommunity Corp., ang itinanghal na winning bidder sa pagpili ng bagong major telco player.
Inihayag ito ng NOW matapos pagtibayin ng Supreme Court ang 2021 ruling at 2022 resolution ng Court of Appeals (CA) kung saan tinanggihan ang petisyon ng kompanya para sa issuance ng ex-parte temporary restraining order at/o writ of preliminary injunction (WPI) upang pigilan ang NTC sa pagpapatupad ng partikular na mga probisyon ng nasabing cicular.
“In sum, the legal proceedings before the Supreme Court pertain to our application for a temporary restraining order and/or writ of preliminary injunction against the National Telecommunications Commission and the conduct of the bidding process for the New Major Player in the Telecommunications Market,” anang kompanya.
“Until the Supreme Court makes its final decision on the merits of the case, the Third Telco bidding shall remain valid and legally effective but may still be subject to the court’s scrutiny and ruling,” giit ng NOW.
Sa gitna ng SC decision, sinabi ng NOW na patuloy nitong pinatatakbo ang telecommunications company base sa frequencies iginawad ng NTC.
Gayundin, inihayag ng NOW na pinalawig ang franchise to operate nito ng 25 pang taon o hanggang 2043. RNT/SA
