MANILA, Philippines – Mas pinalawak ni Justice Secretary Jesus Crispin Remulla ang papel ng mga piskal sa pagtulong sa imbestigasyon na isinasagawa ng mga otoridad sa isang kaso upang matiyak na makakamit ang hatol ng korte.
Inilabas ni Remulla ang Department Circular No. 007 series of 2024 na nag aamienda sa DC 20 na inilabas noong March 2023 o ang “Policy on Pro-Active Involvement of Prosecutors in Case Build-up” to empower prosecutors in case build-ups.
Sa bagong circular, inaatasan ang lahat ng piskal na magkaroon ng ‘proactive role’ sa pagiimbistiga sa mga kasong paglabag sa Customs Modernization and Tariff Act (CMTA), Anti-Agricultural Smuggling Act of 2016 at National Internal Revenue Code.
Magugunita na sa DC 20 nakasaad na dapat makipagtulungan ang mga piskal sa law enforcers upang matiyak na magkakaroon ng malakas na kaso laban sa mga suspek na lumabag sa Dangerous Drugs Act, Anti-Money Laundering Act of 2001, Anti-Terrorism Act of 2020, Terrorism Financing Prevention and Suppression Act of 2012 at iba pang kaso na may katapat na parusa na reclusion perpetua.
“This move is expected to maximize the functions of the NPS which will ensure the existence of a prima facie case and a reasonable certainty of conviction based on available documents, witnesses, real evidence and the like so that efforts in the pursuit of justice will not go to waste.”
Mahigpit ang kautusan ng kalihim na kailangan tiyakin ng mga piskal na mayroon prima facie case bago simulan ang preliminary investigation.
