MANILA, Philippines – Sinabi ng Malakanyang na mas makabubuti kung ang Senado bilang impeachment court, kaysa kay Pangulong Ferdinand Marcos Jr., ang magpapalabas ng subpoena para sa bank records ni Vice-President Sara Duterte, Anti-Money Laundering Council (AMLC), at Bureau of Internal Revenue (BIR) records.
Tinanong kasi si Presidential Communications Office (PCO) Undersecretary at Palace Press Officer Claire Castro kung nakatanggap na ang Office of the President (OP) ng kahit na anumang request para pahintulutan ang pagpapalabas ng bank record ni VP Sara.
“As of now, none has been sent. But in our view, it is more appropriate for the impeachment court itself to issue the orders and subpoenas, considering that the President is also an impeachable official,” ang sinabi ni Castro.
Para kay Castro, ang usapin ay nananatiling hypothetical dahil wala pa namang petisyon ang naihahain na kinukuwestiyon ang kautusan ng impeachment court na payagan ang pagpapalabas ng subpoenas.
“At this point, the question is hypothetical. No petition has been filed yet questioning the impeachment court’s order allowing the issuance of subpoenas for the bank, AMLC, and BIR records,” ang tinuran ni Castro.
Idinagdag pa niya na ang kaso na may kinalaman sa buwis o di umano’y unexplained wealth ay maaaring suportahan ng records na nakuha sa pamamagitan ng court order.
“At sa ating pagkakaalam, ang anumang kaso na may patungkol sa mga buwis at patungkol sa mga unexplained wealth na maaaring makita or ma-substantiate ng mga records na ito, ito ay maaaring ipatawag through a court order,” ani Castro.
Sa ngayon ayon kay Castro, ang Senado ay kumakatawan at pumapapel bilang impeachment court, at sila ang mayroong karapatan at mandato kung paano nila ipatutupad ang kanilang proseso. (KRIS JOSE)
