MANILA, Philippines — Sinabi ni Senate President Vicente “Tito” Sotto III na ang impeachment ay naging “impossible dream” matapos igiit ng Supreme Court ang desisyon nito noong Agosto 2025 na idineklara ang impeachment laban kay Vice President Sara Duterte bilang labag sa Konstitusyon.
Binatikos ni Sotto ang desisyon ng SC bilang “clear encroachment” sa kapangyarihan ng lehislatura.
“The decision is a clear judicial legislation. The SC, as written in their decision, admitted of introducing a rule for Congress to follow in the conduct of impeachment. A clear encroachment on the power of the Legislative branch, as provided for by the Constitution,” ani Sotto.
Inanunsyo ng SC spokesperson Camille Ting na pinataw ng en banc ang unanimous denial sa motion for reconsideration ng House of Representatives, at pinagtibay na ang ika-apat na impeachment complaint laban kay Duterte, na naipadala sa Senado noong Pebrero 5, 2025, ay ipinagbabawal ng Article XI, Section 3, Subsection 5 ng Konstitusyon.
Tinawag ni Sotto ang desisyon bilang “isang malungkot na araw” para sa mga estudyante at propesor ng batas.
“The Constitution had just been amended unconstitutionally through the Supreme Court’s overreach. It will take decades of retirements to correct this misinterpretation. When the law is clear, there is nothing to interpret, as any first-year law student knows,” dagdag niya.
Samantala, ipinahayag ni Senator Imee Marcos ang paniniwala na magsusumite ng panibagong impeachment complaint laban kay Duterte pagkatapos ng Pebrero 6, at tinawag ang desisyon ng SC bilang “a victory for the rule of law.”
Ang ika-apat na impeachment complaint ay sumunod sa tatlong naunang reklamo noong Disyembre 2024, na may kinalaman sa diumano’y maling paggamit ng confidential funds. Noong Agosto 2025, inilagay ng Senado sa archives ang articles of impeachment matapos ideklara ng SC na labag sa proseso ang impeachment. RNT
