MANILA, Philippines – Pinalagan ni ML Partylist Rep. Leila De Lima ang naging resulta ng botohan sa kaniyang mosyon na “exclude the authenticity of the record of the attachment” sa pagtukoy ng “sufficiency in substance.”
Ito ay matapos na maibasura ang mosyon sa pamamagitan ng pagtutol ng may 24 miyembro ng House Committee on Justice samantalang nasa 21 lamang ang pumabor.
Dalawang beses na nagbotohan dahil sa pagdududa ni Batangas Rep. Gerville Luistro sa unang resulta ng botohan at saka lamang nito binasa at kinumpirma ang bilang ng pumabor at tumutol matapos ang ikalawang pagbilang matapos niyang linawin ang mosyon.
Agad namang nagpahayag ng kaniyang saloobin si De Lima sa pagsasabing kapag sinunod ang mosyon ay “tatagal ang proceedings at unfair ito sa mga complainants.”
Naunang kinuwestyon ni Cagayan de Oro Rep. Rufus Rodriguez ang pagmosyon ng isa sa mga endorser na si Kabataan Partylist Rep. Renee Co sa ikalawang impeachment laban kay Pangulong Marcos ukol sa kung dapat o hindi dapat ikunsidera ang pagiging authentic ng attachment sa inihaing reklamo.
“All the endorsers that in the deliberation of the committee, they cannot participate. This is a proceeding akin to preliminary investigation. So the complainant and their lawyers will not be the one moving to the prosecutors to proceed with the case, and so therefore with due respect let us allow our members. Of course, we will appreciate you on the proper time discussions to elaborate further the complain.”
Sa panig ng chairman ng Committee on Justice ay nagsabi ito na walang nilalabag si Co na magpahayag ng mosyon o saloobin sa pagdinig dahil siya at ang dalawa nitong nag-endorso ng ikalawang impeachment laban sa Pangulong Marcos ay pawang mga miembro ng komite.
“The chair rules in favor of the authority and right of the member notwithstanding the fact that she is an endorser as well to raise the necessary motion. It is not the intention of this committee to impair whatever rights and authority each of the member has in this committee. So if we are upholding the right of a member who is a the same time and endorser to raise a motion, we are likewise upholding her right to vote on the motion,” ayon kay Luistro.
Matapos ang botohan sa mosyon ay itinuloy ang deliberasyon sa unang reklamo na nakapaloob sa impeachment case na inihain ni Atty. Andrei De Jesus na inindorso naman ni Pusong Pinoy Partylist Rep. Jernie Jett Nisay ukol sa alegasyon ukol sa pag-kidnap ay dating Pangulong Rodrigo Roa Duterte at dinala ito sa The Hague na nakapaloob sa reklamong Culpable Violation of the Constitution.
Subalit iginiit naman ni Ako Bicol Rep. Garbin na hindi ito maaaring ibilang sa ground ng impeachment laban sa pangulo dahil ang usapin ay nakabinbin pa rin sa Korte Suprema. (Meliza Maluntag)
