MANILA, Philippines – Bawal sa 1987 Constitution si Vice President Sara Duterte na lumahok sa anumang uri ng negosyo habang nanunungkulan, ayon sa isang testigo mula sa Securities and Exchange Commission (SEC) nitong Lunes sa ika-27 araw ng impeachment trial ng Bise Presidente.
Ibinigay ni SEC Company Registration and Monitoring Department Director Gerardo Fernando Del Rosario ang testimonya sa direktang pagsusuri ni private prosecutor Erwin Matib, kung saan binanggit niya ang Article 7, Section 13 ng Konstitusiyon.
“We have a provision sa ating Constitution na nagsasabi na ang Presidente, Vice President, Cabinet members, maging ang kanilang deputies, ay hindi maaring maghold ng ibang opisina, magkaroon ng ibang trabaho, mag-engage sa ibang propesyon, magkaroon ng business interest, upang maiwasan po iyong conflict of interest,” sagot ni Del Rosario nang tanungin ni Matib kung pinapayagan ba si Duterte na magsilbi bilang isa sa Board of Directors ng mga kumpanyang may business interest siya batay sa SEC records.
Kabilang sa mga negosyong ito ang Metro City Chow Foods Corporation at City Hall King Chow Foods Corporation, at iba pa.
Nakasaad sa Article 7, Section 13 ng Konstitusiyon na “The President, Vice-President, the Members of the Cabinet, and their deputies or assistants shall not, unless otherwise provided in this Constitution, hold any other office or employment during their tenure.
“They shall not, during said tenure, directly or indirectly, practice any other profession, participate in any business, or be financially interested in any contract with, or in any franchise, or special privilege granted by the government or any subdivision, agency, or instrumentality thereof, including government-owned or controlled corporations or their subsidiaries,” ayon sa opisyal.
Tinanong naman ni Senate impeachment court presiding officer Francis Escudero si Del Rosario kung tahasang binanggit ang pariralang “business interests” sa Konstitusyon, at sumagot si Del Rosario na nauunawaan niya ito bilang pagbabawal na “to participate in business.”
Tumutol si defense counsel Justin Gular sa tanong ni Matib kay Del Rosario at sinabing humihingi ito ng konklusyon ng batas at katotohanan.
Gayunpaman, pinayagan ni Escudero na magpatuloy si Matib.
“I’ll allow it because I’m also interested to find out if they flagged it or not,” ani ng presiding officer ng impeachment court.
Sa oras ng pagsulat ng balita, hindi pa nababanggit ni Del Rosario kung may na-flag na anumang negosyo na may kaugnayan sa Bise Presidente. Ernie Reyes
