MANILA, Philippines – BINATIKOS ni Vice President Sara Duterte ang Armed Forces of the Philippines (AFP) makaraang pahintulutan na arestuhin ang kanyang ama na si dating Pangulong Rodrigo Duterte, na ang batayan lamang ay ang foreign tribunal warrant.
Kinuwestiyon ni VP Sara ang ‘constitutionality’ ng pag-aresto sa kanyang ama noong Marso 11 sa isinagawang pagdinig ng Senate Committee on Foreign Affairs’ ukol sa hurisdiksyon ng International Criminal Court (ICC), kung saan sinampahan ang dating Pangulo ng crimes against humanity of murder na may kaugnayan sa kanyang madugong ‘war on drugs campaign.’
“Even more disturbing is the silence of the Armed Forces of the Philippines. Why did the AFP stand idly by while a former Commander-in-Chief was taken from a military base under questionable circumstances? How could they allow a foreign tribunal to override on our constitutional guarantees?,” ang sinabi ni VP Sara.
Kinuwestiyon din ni VP Sara kung bakit pinayagan ng Presidential Security Command (PSC), isang unit sa ilalim ng AFP na arestuhin ang kanyang ama. Ang PSC ang ‘in charge’ sa proteksyon ng kanyang ama.
“Because under the law, the Presidential Security Command (a unit under the AFP) is in charge of the security of former presidents. So, bakit nila hinayaan na mangyari ito sa isang dating pangulo ng ating bayan?,” ang balik tanong ni VP Sara.
Kinuwestiyon din ni VP Sara ang “authority” ng Philippine National Police (PNP), na nanguna sa pag-aresto sa kanyang ama base sa ICC warrant sent na ipinadala sa International Criminal Police Organization (Interpol).
“Under whose authority did the PNP act? Why did it enforce a foreign warrant without the Philippine court order? Why didn’t they at least bring PRRD before a judge as required by the Rome Statute itself?,” ang muling tanong ni VP Sara.
May ilang legal experts ang nagpaliwanag na hindi obligado ang gobyerno ng Pilipinas na ipadala ang dating Pangulo sa local court lalo pa’t hindi na miyembro ng ICC ang Pilipinas matapos na kumalas ang dating Pangulo mula sa Rome Statute noong 2019.
Inaasahan naman na uungkatin ng kampo ng dating Pangulo ang proseso ng pag-aresto kay Digong Duterte at ang hurisdiksyon ng ICC para iapela na ibasura ang kaso bago pa ang Sept. 23 hearing sa ICC.
Sumigaw din ng ‘foul’ si V Sara sa kakulangan ng due process sa pag-aresto sa kanyang ama.
“Even granting for the sake of argument that we have some duty to cooperate with either the ICC or Interpol, does that duty override the fundamental rights of every Filipino enshrined in our Constitution?,” ang tanog ni VP Sara.
“What happened on March 11, 2025, is not just about one man. It is about all of us. It is about the country. If a former president can be taken without due process, what stops them from doing the same to any other Filipino?,” aniya pa rin.
“We have now lost a former president. I pray that we do not lose the country next,” ang sinabi ni VP Sara.
Samantala, sinabi pa ni VP Sara sa Senate hearing na
“Alam naman natin lahat, at alam nila na mali ang ginawa nila. Ginawa nila iyon just to demolish political opponents. This is all about politics. The administration is using government resources, the ICC, to demolish the opposition.”
“Ang tanong ngayon, ano ang gagawin natin para maibalik ang dating Pangulo sa Pilipinas? Kasi, nag-iisa ako ngayon dito na gumagawa ng paraan para maibalik ang ating dating Pangulo sa ating bayan,” ang diing pahayag ni VP Sara.
