MANILA, Philippines – Ipinanawagan ng isang mambabatas ang kahalagahan ng pagbuo ng inter-agency memorandum circular upang pagbutihin ang implementasyon ng batas na naggagawad ng mga discount at benepisyo sa mga senior citizen, persons with disabilities (PWDs), at solo parents.
Ayon kay Bagong Henerasyon Party-list Rep. Bernadette Herrera, ang mga butas sa implementasyon ng Republic Act (RA) 9994 (the Expanded Senior Citizens Act of 2010) at RA 10754 (an Act Expanding the Benefits and Privileges of PWDs) ay posibleng mas mabilis na maresolba sa pagsasaayos ng ilang implementing rules and regulations (IRR) sa pamamagitan ng isang joint memorandum circular o kautusan.
Aniya, maaaring maresolba ng Bureau of Internal Revenue, Department of Trade and Industry, Department of Social Welfare and Development, Land Transportation Franchising and Regulatory Board, at iba pang ahensya ang karamihan sa mga isyu at reklamo sa pamamagitan ng isang joint-inter-agency IRR.
“Many of the suggestions presented during the joint House hearings on the availment of discounts for PWDs, seniors, and solo parents do not need new legislation,” ani Herrera.
“I appeal to President Ferdinand R. Marcos Jr. to direct these agencies to resolve the administrative issues among themselves.”
Binusisi sa isang pagdinig sa Kamara ang mga reklamo laban sa mga establisyimento na hindi nagbibigay ng diskwento, partikular na ang 20 percent discount at 12 percent value-added tax exemption.
Aniya, mayroon pa ring “some wiggle room or flexibility” na inilagay sa mga batas sa PWDs, solo parents, at senior citizens, na maaaring magamit ng implementing agencies upang makabuo ng mga kinakailangang IRR adjustments.
Ayon kay Herrera, kung hindi pa rin sasapat ang joint inter-agency IRR ay maaaring maglabas ng executive order ang Pangulo.
Sa kabila nito, iginiit din ni Herrera na ang ilang mga reklamo at isyu ay kailangan na amyendahan ang ilang kasalukuyang batas, katulad ng pagpapalit sa lahat o ilang limitasyon ng DTI na inilagay sa purchase discounts.
“Requiring online portals and apps to be user-friendly to PWDs, seniors, and solo parents, as well as students, may have to be made more explicit and clear in amendments to current laws. It seems some establishments and merchants may have become experts at spotting loopholes in the laws and regulations,” ayon sa mambabatas. RNT/JGC
