MANILA, Philippines- Aabot sa 204.3 bilyon ang maaaring i-refund ng National Grid Corporation of the Philippines (NGCP) sa publiko, ayon kay House Ways and Means Committee Chairman at Albay Rep. Joey Salceda.
Sa naging presentasyon ni Salceda sa komite, ipinaliwanag nito na mula 2016 hanggang 2020 ay nasa P183.5 bilyon ang inaprubahang revenue ng Energy Regulatory Commission (ERC) para sa NGCP, subalit sa kabuuan, ang kinita ng NGCP ay nasa P387.8 bilyon, o sobra ng P204.3 bilyon.
“This underscores the urgent need for legislative action and direct these excess revenues in refunds. There is a 204.3 billion that has been computed by the ERC as being in excess of each WACC (Weighted Average Cost of Capital),” paliwanag ni Salceda.
Aniya, anumang sobra sa WACC ay dapat ibalik.
“WACC belongs to the people or belongs to the state. if it’s a franchise that deals with the consumers, then the excess revenues belong to the consumers. And, there should be a process of disgorgement, of repayment,” dagdag pa nito.
Sinabi ni Salceda na ang NGCP ay ang nag-iisang major player sa power sector na hindi nagbabayad ng Corporate Income Tax (CIT), Value-Added Tax (VAT) at Real Property Tax (RPT).
Kumpara umano sa NAPOCOR na ang sobrang kinikita ay may obligasyon silang i-reinvest habang ang TRANSCO ay kailangang i-remit ang sobrang kita sa PSALM Corp., sa kaso ng NGCP ay walang malinaw na rate of return mechanism.
Ipinanukala ni Salceda na irebyu ang prangkisa ng NGCP at isa sa mga rekomendasyon nito ay gamitin ang sobrang kita ng NGCP bilang consumer subsidies.
Samantala, inirekomenda rin ni Salceda ang pagsasagawa ng imbestigasyon kaugnay ng paglabag sa Anti Dummy Law ng National Grid Corporation of the Philippines (NGCP).
Kasunod ito ng paglitaw na ang NGCP ay mayroong kuwestiyonableng ownership structure, governance at posibleng paglabag sa nakasaad sa Konstitusyon na ipinagbabawal ang foreign ownership sa public utilities.
Ang NGCP, nagmamantine at nag-ooperate ng power transmission grid ay dapat 60% na pagmamay ari ng Pilipino, batay sa kanilang datos ang kompanya ay 60% na pagmamay-ari ng Filipino company na Synergy Grid of the Philippines (SGP) habang ang 40% ay hawak ng State Grid Corporation of China (SGCC).
“While the NGCP has denied that it is controlled by the [SGCC], and that it has no executives that are Chinese nationals, its Chairman is Chinese, a top official of the SGCC, despite [SGP] supposedly being a larger shareholder than the [SGCC],” paliwanag ni Salceda.
“We must look into the citizenship of the individual stockholders, i.e., natural persons, of that investor corporation to determine if the constitutional and statutory restrictions are complied with,” dagdag ng mambabatas.
Nais ding masilip ni Salceda sa gagawing imbestigasyon ang pagkakaroon ng Chinese nationals sa Board of Directors ng NGCP.
Ang NGCP Board ay kinabibilangan nina Chairman Zhu Guangchao (Chinese); Vice Chairmen Robert Coyiuto Jr. (Filipino)at Henry Sy Jr. (Filipino); President/CEO Anthony Almeda (Filipino); at mga Directors na sina Jose Pardo (Filipino), Francis Chua (Chinese), Shan Shewu (Chinese), Liu Ming (Chinese), Liu Xinhua (Chinese) at Paul Sagayo Jr. (Filipino).
Ani Salceda, ilang report ang kanilang natanggap na ang SGCC ang siya nang may kontrol sa NGCP na malinaw na paglabag sa Anti-Dummy Law na malinaw na nagbabawal na magpartisipa sa management, operation, administration, o control sa public utilities ang mga hindi Filipino.
“For violations of the Anti-Dummy Law, the penalty of forfeiture of ‘such right, franchise, privilege, and the property or business enjoyed or acquired in violation of the provisions of this Act’ may be imposed,” giit ni Salceda. Gail Mendoza
